Contract USPTO Trademark & Patent Attorney (Independent Contractor)

Position:

**Contract USPTO Trademark & Patent Attorney (Independent Contractor)**

About Us:

We are an intellectual property support company that assists clients with U.S. trademark and patent matters. We are looking to establish a long-term relationship with a licensed U.S. attorney who can act as the attorney of record for USPTO filings and related matters on an as-needed basis.

This is **not a full-time or part-time employment position**. Instead, we are seeking an attorney who is comfortable working on a per-project, independent contractor basis.

Attorney Qualifications:

The ideal candidate should:

* Be licensed to practice law in at least one U.S. state or territory and maintain an active bar membership in good standing.

* Be authorized to represent applicants before the USPTO in trademark matters.

* Have experience with U.S. trademark law and USPTO filing procedures.

* Knowledge of patent prosecution is preferred. Registration to practice before the USPTO in patent matters is a plus, but not mandatory if only trademark work will initially be assigned.

* Be responsive, detail-oriented, and comfortable working remotely.

Scope of Work:

Initially, the attorney's primary responsibilities will include:

Trademark Filings

For each new client matter, we will provide:

* Completed client intake information

* Owner details

* Mark information

* Goods and services

* Filing basis

* Specimens (when applicable)

* Signatures and declarations

* Any additional supporting documentation

Your responsibilities will be to:

* Review the provided information for completeness and legal sufficiency.

* Raise any concerns or legal issues that should be addressed before filing.

* Make any necessary attorney-level judgment calls where appropriate.

* Submit the trademark application through the USPTO.

* Serve as attorney of record for the application if mutually agreed.

USPTO Post-Filing Matters:

From time to time, assistance may also be required with:

* Responses to Office Actions

* Statements of Use (SOU)

* Extensions of Time

* Amendments

* Examiner's Amendments

* Ownership changes/assignments

* Maintenance filings

* Other routine USPTO submissions

For these matters, we will generally prepare a complete draft response and supporting documentation. The attorney will be expected to:

* Review the submission for legal accuracy.

* Make any edits or corrections deemed necessary.

* Ensure compliance with USPTO rules and ethical obligations.

* Submit the filing through the USPTO.

Compensation:

* **Trademark application filing:** USD $75 per completed filing.

* Payment will be made promptly after successful submission of each filing.

Expected Volume:

Current anticipated workload:

* Approximately **100 trademark applications per month**, with the potential for additional growth.

* Ongoing post-filing work throughout the prosecution process.

Working Relationship:

We are seeking a long-term working relationship with an attorney who values consistency, efficiency, and open communication.

Our goal is to streamline the administrative process by providing organized filing packages so the attorney can focus on reviewing the legal aspects of each matter and ensuring compliance with USPTO requirements.

Ideal Candidate:

We are looking for someone who:

* Wants recurring work without client acquisition responsibilities.

* Is comfortable handling a high volume of trademark filings.

* Can maintain reasonable turnaround times.

* Is interested in building a long-term professional relationship.

* Appreciates receiving well-organized filing packages that minimize administrative work.

Pay: $1,500.00 - $4,500.00 per month
