Overview
ProperHeir is an inheritance recovery company that helps families unlock the value of inherited real estate. We work with heirs facing probate, title issues, co-owner disputes, partition actions, foreclosure, reverse mortgages, and other legal obstacles that prevent inherited property from being sold.
We are seeking a business-minded In-House Probate & Real Estate Litigation Attorney to join our leadership team. This role goes far beyond traditional legal work. You'll oversee legal matters related to probate, litigation, title, and real estate while working alongside leadership to solve complex problems, improve systems, and help scale the business.
If you're looking for a role where your legal expertise directly influences company strategy and client outcomes, we'd love to meet you.
Why This Role Is Different
This is not a traditional attorney role. You'll have a seat at the leadership table and be expected to think like a business owner, not just legal counsel. We value attorneys who can identify risk, propose solutions, improve processes, and help drive the business forward. You'll work alongside our acquisitions, operations, and leadership teams to solve complex real estate and inheritance challenges while helping shape the future of the company.
We're looking for someone who sees the law as a tool to create solutions, not obstacles. The right person is entrepreneurial, decisive, resourceful, and excited to build something bigger than a traditional legal practice. If you enjoy strategy, operations, real estate, and making an impact beyond the courtroom, you'll thrive at ProperHeir.
Responsibilities
- Manage probate matters from intake through resolution.
- Handle or oversee partition actions, quiet title actions, and other litigation involving inherited real estate.
- Draft and review pleadings, motions, petitions, settlement agreements, deeds, contracts, and legal correspondence.
- Represent the company and clients in hearings, mediations, depositions, and court proceedings as needed.
- Analyze title issues, ownership disputes, probate files, wills, deeds, and court records to determine legal strategy.
- Work closely with acquisitions, operations, and transaction teams to remove legal roadblocks and keep cases moving.
- Provide legal guidance before purchasing inherited property interests.
- Develop creative legal strategies to resolve difficult inheritance and real estate matters.
- Coordinate with outside counsel, title companies, surveyors, closing agents, and court personnel.
- Help build and improve legal systems, internal processes, and workflows as the company grows.
- Identify legal risks while offering practical business solutions.
- Stay current on Florida probate, real estate, and civil litigation laws.
What We're Looking For
We're less concerned with the number of years you've practiced law and more interested in how you think.
We're looking for someone who sees legal work as a tool to solve business problems—not someone who simply identifies obstacles. The ideal candidate is entrepreneurial, decisive, and enjoys working alongside business leaders to create practical solutions.
You might be a practicing attorney, a former real estate professional turned attorney, or someone who has spent time in title, probate, investing, or another business-focused legal environment. If you're naturally curious about how businesses operate and enjoy building systems—not just practicing law—you'll likely thrive here.
Qualifications
- Juris Doctor (JD) from an accredited law school.
- Active member of The Florida Bar (or eligible for admission).
- Strong legal writing, research, and analytical skills.
- Excellent communication and negotiation skills.
- Ability to manage multiple legal matters simultaneously.
- Comfortable working in a fast-paced, entrepreneurial environment.
- Strong attention to detail while maintaining a solutions-oriented mindset.
- Ability to collaborate across departments and communicate legal concepts in plain English.
Bonus Points If You Have Experience In
- Probate or estate administration
- Probate litigation
- Real estate litigation
- Partition actions
- Quiet title actions
- Title insurance or title curative work
- Real estate investing
- Real estate brokerage
- Entrepreneurship or business ownership
- Construction or development
- Negotiation and dispute resolution
None of these are required. We care far more about your ability to learn, solve problems, and think like an owner than checking every box.
What Success Looks Like
- You remove legal obstacles instead of creating them.
- You help the business move faster while managing risk appropriately.
- You think proactively and identify issues before they become problems.
- You improve systems instead of simply maintaining them.
- You become a trusted advisor to leadership, not just the company's attorney.
- You help families navigate difficult inheritance situations while protecting the company's interests.
