- IP. Responsibilities include: As a member of the professional staff, contributes general knowledge and skill in Intellectual Property to assist and support IP team and/or Law Department objectives. Works under close supervision or within well-established guidelines to complete routine tasks. Assists paralegals and attorneys by performing a variety of legal-related tasks under the direction of an attorney, Managing Paralegal and/or more senior paralegal, including trademark docketing and portfolio support or management; and drafting simple legal documents, correspondence and business communications. May be required to perform related clerical duties pertaining to the law-related tasks. This position is located in the Law Department in Bethesda and reports to the IP Group leader (VP & Senior Counsel). Specific Job Summary Enter and update data and records in trademark database and other databases used by the IP practice. Track/monitor appropriate deadlines and generate database reports as appropriate. Create and maintain paper and/or electronic files of IP correspondence, documents and evidence. Prepare summaries and status reports of trademark and other IP rights and/or cases for review of in-house counsel and/or for clients, and field inquiries from clients regarding various trademark/copyright issues. Oversee execution and legalization of documents (such as trademark Assignments and Powers of Attorney) for submission in international trademark matters. Draft legal correspondence and memoranda for attorney review. Review outside counsel and other vendor invoices for accuracy and process payment of same within IP Group processes. Assist with or handle trademark search requests from clients. Tasks may include receiving such requests, conducting on-line trademark screening searches (and/or working with outside counsel for same), evaluating results and reporting preliminary opinion to clients regarding availability of mark(s) for use and/or registration; and/or ordering and reviewing full trademark searches and investigating relevant listings for details of use (and/or working with outside counsel for same), evaluating results and drafting opinion memos to clients regarding availability of mark(s) for use and/or registration. Assist with or handle various aspects of U.S. trademark prosecution and maintenance, including maintenance of files, preparation and filing of applications, Office Action responses, ITU-related documents (e.g., Statement of Use), and Post Registration documents (e.g., Sections 8 and/or 15 Affidavits). Assist with or oversee filing and maintenance of international trademark applications and registrations, including maintenance of files, reviewing correspondence from foreign counsel and drafting responses to same, and gathering and providing foreign counsel with information/documentation necessary to prosecute/maintain trademark applications and registrations. Assist with or prepare Assignments of trademark registrations and applications and file same with PTO Assignment Branch. Assist with or investigate possible infringements and draft written letters or memos when appropriate. Assist with due diligence and other intellectual property issues related to contracts, agreements, and other transactional matters. Under close supervision or following well-established guidelines, responds to, solves and makes decisions on standard/routine business requests with limited risk. Responsible for own work and contributing to team, department and/or business results. May direct work of non-management staff. Assists more senior associates in achieving business results by:
- utilizing technical knowledge and skills to enhance business processes.
- following and contributing to IP Group protocols, processes and best practices.
- establishing priorities for self and, where appropriate, others.
- allocating own time effectively to meet goals in a manner that does not disadvantage other associates/groups.
- contributing to department/unit budget as appropriate (i.e., input, following guidelines, etc). Demonstrates an awareness of personal strengths and areas for improvement and acts independently to improve and increase skills and knowledge. Perform other duties and special projects as requested; may involve handling confidential and sensitive material. Candidate Profile Successful candidates should possess knowledge and experience and demonstrate strong leadership and relationship skills as follows: Four-year college degree or equivalent qualifying work experience with an outstanding performance record; certificate from an ABA-approved paralegal program helpful but not required. Minimum of three years of substantive and applicable experience as a trademark/copyright paralegal performing the specific functions set forth below in a law firm or corporate law department; Ability to work independently and as part of a team; Ability to manage multiple tasks well under pressure; Level of expertise/knowledge to manage tasks that have a broad and direct impact on business; Ability to structure complex projects efficiently and set/adjust priorities effectively; superior attention to detail; excellent judgment and use of discretion; Diligence, dependability and strong work ethic; Superior organizational and interpersonal skills; Excellent written and oral communication skills; Proficiency in a trademark database (e.g., CPI) and in online trademark searching (e.g., Corsearch) preferred.
