Collections Attorney

Collection agency headquartered in Northern Indiana. Founded in 1999, this agency has more than 76 years of combined collections and legal experience. This agency has significant third-party collections experience with large medical practices, regional dentist practices, real estate managers, and commercial businesses. The agency is vertically integrated with an experienced team of collectors, paralegals, and in-house attorneys.

The Collections Attorney manages/resolves collection litigation; provides legal support for the legal department; oversees or interacts with outside collections/defense counsel; provides legal advice in connection with the company's business operations; supports corporate compliance with laws and regulations governing debt collection and related activities; conducts legal research; and, assists with special projects as required.

Responsibilities:

  • Significant presence in courtroom proceedings including bench trials
  • Create, review, direct and resolve collection litigation matters cost-effectively by working with business clients and legal support staff.
  • Ensure adherence to Fair Debt Collections Act, Gramm Leach Bliley, Heath Information Portability and Accountability Act, as well as other federal and state laws by enforcing relevant company policies. Determine appropriate settlements with consumers experiencing temporary or permanent hardships, and communicate with consumer and counsel to encourage financial recovery.
  • Maintain and enhance company reputation with courts, vendors, outside counsel, and consumers. Limit company exposure through effective advocacy on behalf of the Company in hearings, trials, and mediations. Negotiate with opposing counsel, conduct discovery, respond to discovery, prepare and attend hearings and trials.
  • Provide legal advice to company to support compliance with federal, state and local laws.

Qualifications and Education:

Required: Admission to the Bar of the State of Indiana. Willing to seek admission to the Bar of the State of Michigan.

Preferred: Experience with collections as an attorney is a plus.

0-3 years of experience as a practicing attorney.
