WHO'S IN THE KITCHEN Blue Apron is seeking a bright, energetic, business-minded and self-motivated attorney with 6-8 years of proven digital and technology commercial transactions and privacy/data security experience gained at a leading law firm and in-house at a technology or Internet (ideally consumer-facing web or ecommerce) company to join its Legal Department; product counseling experience a strong plus. In this position, you will lead the Legal Department’s efforts in the foregoing areas, working closely with our Engineering, IT, Human Resources and Internal Audit teams, and interface regularly with members of our executive and other business teams, to manage and execute on a broad range of privacy-, data security- and information management-related initiatives. This position reports directly to the General Counsel and Corporate Secretary and is based in the company’s corporate headquarters in New York City’s Flatiron neighborhood.

WHAT'S ON THE MENU This position’s principal responsibilities and duties include:
  • Review, draft, negotiate and provide business focused legal advice with respect to digital and technology commercial transactions including negotiating a variety of coverage area-specific commercial agreements, including license, vendor, SaaS, technology, master services, confidentiality and other agreements, and supporting the Legal Department’s negotiation of applicable privacy and data security provisions of inbound and outbound agreements
  • Drafting privacy policies, related disclosures, disclaimers, FAQs and communications, and implementing appropriate processes applicable to the foregoing
  • Having primary responsibility for the continued development of our privacy strategy and compliance framework, developing and communicating controls, policies and procedures, performing risk assessments, monitoring ongoing compliance and overseeing the intersection of privacy and data security in collaboration with the information security team
  • Advising appropriate stakeholders on compliance matters across all aspects of U.S. and, where applicable, international privacy laws and regulations, including data protection, retention, use/sharing, security and breach rules, as well as required privacy notices, regulatory filings and relevant process and infrastructure requirements, as applicable
  • Advising Marketing team on privacy implications of various marketing initiatives, including online advertising, behavioral advertising, affiliate marketing, mobile applications, social networking, email, SMS/text, and other customer-facing communications
  • Leading data incident response preparedness, including practicing and evolving our data incident response plan
  • Working with our information security team to support data incident response management, including determining and drafting any required third party notifications and related communications
  • Overseeing our information and records management, including alignment with privacy and security policies
  • Keeping abreast, and advising on potential business impact, of proposed changes to applicable privacy, data security, consumer protection, marketing and related laws and regulations
  • Building close relationships with personnel at supported business operations, and obtaining and maintaining a strong knowledge of the products and objectives of those operations
  • Conducting periodic employee trainings on relevant matters, such as privacy, data protection and records management
  • Leading or assisting the Legal Department’s efforts in the preparation, implementation and refinement of appropriate forms, processes and procedures relevant to areas of coverage
  • Managing outside counsel in all appropriate areas of coverage
  • Providing substantive support to other members of the Legal Department on an as-needed basis, including engaging in or leading due diligence and related support efforts on strategic transactions
  • Performing other special assignments or strategic projects as needed
NECESSARY INGREDIENTS
  • J.D. from a top law school with exceptional academic credentials and 6-8 years of relevant experience, including at least three years at a leading national law firm as a technology commercial transactions attorney with privacy/data security experience and significant time spent in-house at a technology or Internet (ideally consumer-facing web or ecommerce) company in roles of increasing responsibility
  • Must be admitted, active and in good standing with the New York State bar, or with another state bar and registered, or eligible to register, as in-house counsel with the State of New York
  • CIPP/US or CIPM certification preferred
  • Experience interacting directly with federal and state law enforcement personnel or privacy and data protection regulators a plus Interpersonal Skills and Competencies
