The Director and Senior Counsel is responsible for handling complex legal matters and projects for Discover Student Loans in relation to marketing, origination and servicing. This includes providing legal advice, direction and training to clients, supporting a risk-aware culture and ensuring effective risk management practices in accordance with relevant laws, regulations, and company policies.
The Director and Senior Counsel will identify, assess and communicate legal and relevant regulatory requirements and industry best practices relevant to the Company and its businesses, manage assigned resources and budgets, including outside counsel spend. There is emphasis on proactive monitoring, governance, risk identification and escalation, as well as making sound risk decisions commensurate with the business units risk appetite and all risk and compliance program requirements.
Consulting with and advising senior business unit leadership on complex legal issues. Advising on marketing strategies and disclosures.
Working with management to implement servicing strategies and processes.
Informing management regarding legal developments that may affect business practices and strategies.
Working with business unit risk and compliance officers on student loan risk management program strategies and initiatives.
Supporting examination and other CFPB and FDIC supervisory activities.
Contributing to the creation of a favorable regulatory environment.
Working with Government Relations on regulatory and legislative proposals.
Analyzing and preparing comment letters and position papers on proposed regulations and legislation.
Analyzing and advising business clients on new and amended regulations and laws.
J.D. degree required.
8+ years of relevant experience and a strong understanding of consumer financial services laws and regulations that apply across the consumer lending life cycle.
Experience advising on consumer financial service matters; experience advising on student loan matter preferred.
