Overview
The Operations and Compliance Officer will report directly to the COO and CEO, providing support across a broad spectrum of corporate and commercial healthcare matters. This role involves handling a wide array of responsibilities, including healthcare operations, CODA certification processing and compliance, lease negotiation and management, provider and employee relations, MCO relationships, insurance claims, and real estate development projects ensuring regulatory compliance. This position is on-site in Dallas, Texas.
Responsibilities
- Work proactively across all departments to mitigate legal issues, provide practical advice and as act as a liaison between departments to improve communication and efficiency.
- Provider recruitment, retention, and payroll oversight
- Review, negotiate, and manage all provider and employment contracts
- Oversee provider compliance and performance analytics
- Provide counsel and on-going training on various federal and state regulatory requirements such as HIPAA, fraud and abuse laws, Stark and anti-kickback issues, and licensure matters.
- Build state-compliant models while conducting regulatory diligence and oversight for existing and future business ventures
- Build out SOP and training manuals for relevant laws, rules, and regulations
- Review, negotiate, and approve real estate agreements including leases.
- Prepare, review and revise provider, vendor, and construction contract agreements
- Manage construction lien releases
- Manage any labor and employment related disputes while creating and collaborating on policies and procedures to mitigate HR related risks.
- Provide counsel on HR concerns such as FMLA, policy violations, UI claims, etc.
- Develop and implement SOP for annual performance reviews and performance management
- Develop and Implement facility security alarm monitoring and response SOP
- Serve as a resource for executive team members as it relates to the legal components of their various departments.
- Assist with ensuring awareness of and compliance with applicable laws and company policies and procedures.
- Oversee annual filings, registrations, and meetings
- Oversee liability and workman’s compensation claims
- Oversee Insurance site audits, appeals and responses
- Periodically review fee schedules and fee negotiations
- Oversee MCO (Managed Care Organizations) updates and relationships
- Oversee intellectual property management including trademarks, copyrights, and DBA’s
- And other duties as assigned
Qualifications
- 5+ years of corporate or operational healthcare experience.
- Juris Doctorate (JD) from accredited law school
- Ability to identify and manage legal risks within the healthcare environment, including those related to insurance, patient care, operations, and financial matters.
- Expertise in negotiating and drafting contracts including employment agreements, payor contracts, corporate leases, and service vendor contracts.
- Strong understanding of regulatory frameworks governing healthcare, and experience developing and implementing compliance programs.
- Ability to work collaboratively with various departments including operations, HR, marketing, revenue cycle & billing, finance, and IT.
