The Department of Children and Families seeks dedicated child welfare professionals who are committed to upholding the Department’s fundamental mission of protecting children from abuse and neglect to ensure they are able to grow and thrive in a safe and nurturing environment. Acts as a lawyer for the Massachusetts Child Welfare Agency. The primary responsibility will be to work with other members of the Department to timely respond and collect data necessary for compliance with the Freedom of Information law and the Governor’s Executive Order. In collaboration with the Deputy General Counsel, draft necessary regulations and policy for the Department. Work on procurement for the Department and assist in any state or federal audits related to the Department’s compliance with both state and federal laws and regulations.

1. Drafts responses to Freedom of Information requests, including but not limited to initial response and obtaining the necessary records for production of such


2. Respond, when necessary, to the Supervisor of Public records.

3. Respond to requests for records on behalf of the General Counsel.

4. Assist in the drafting of policy and regulations in order to maintain the

Department’s compliance with both state and federal mandates.

5. Assist Procurement Management Teams for the Department to purchase

services in compliance with state law.

6. Assist in ensuring the Department’s compliance with Title IVE and work with

agency legal, financial and revenue staff and agency revenue provider to

maximize the Department’s revenue.

7. In collaboration with other units of the Department, assists in agency state and

federal audits.

8. May act as liaison to the Attorney General’s Office in litigation against the

agency, including responding to discovery and assisting in settlement


9. Conducts legal research on matters relating to agency functions; prepares

related reports and memoranda, including investigation and analysis of

potential tort claims against agency. Interprets laws, court decisions and

opinions, rules and regulations applicable to the agency; and

10. Conducts training of agency staff on legal issues pertaining to agency work,

litigation processes, changes to law, regulation or policy, or other topics as


1. Considerable knowledge of the laws, rules, regulations, and legal opinions

governing the functions of the child welfare agency;

2. Knowledge of the laws of the Commonwealth and Federal laws, including Title

IV-E of the Social Security Act.

3. Experience in the areas of Freedom of Information requests, litigation

procurement and contracts;

4. Demonstrated commitment to the core practice values of the agency;

5. Ability to interpret and prepare opinions on court decisions, rules and


6. Exposure to Litigation – through course work, internship, paralegal or litigation experience.

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
