Attorney – Marketing, Regulatory, and Retail Operations

COMPANYBACKGROUND:
Through Victoria's Secret, PINK and Bath & Body Works, L Brands is an international company that sells lingerie, personal care and beauty products, apparel and accessories. As part of L Brands’ strategy announced on May 4, 2020, the company remains committed to establishing Bath & Body Works as a standalone public company and is taking the necessary steps to prepare the Victoria’s Secret Lingerie, Victoria’s Secret Beauty and PINK businesses (collectively, Victoria’s Secret) to operate as a separate, standalone company. Please note: Once Bath & Body Works is established as a standalone company, the Attorney will continue to provide this support to Bath & Body Works.
REPORTINGRELATIONSHIP:
AVP, Legal Counsel – Marketing, Regulatory, and Retail Operations
RESPONSIBILITIES:
The Attorney will support Marketing, Regulatory, and Retail Operations activities (worldwide) to ensure that L Brands’ retail brands (Victoria’s Secret, PINK, and Bath & Body Works) and their parent company comply with laws governing marketing, regulatory issues, and retail operations. The Attorney will also support privacy, information security, and commercial contracting functions.
The Attorney must:
Assess and mitigate risk
Develop relationships with key stakeholders across multiple brands and functions
Make strategic and operational decisions
Collaborate on and implement compliance solutions
Develop assurance plans
Manage day-to-day review and advice, in real time
Conduct training
Assist with or manage litigation
Manage outside counsel
Take a long-view approach to identify emerging issues, mitigate risk, and continuously improve processes
Translate legal requirements into business rules that business can easily comprehend and implement
Evaluate compliance standards for improvement
The Attorney will assist in the following areas:
Marketing
Work with leads on marketing and/or customer-engagement initiatives or campaigns
Review campaigns, collateral or projects that involve pricing, promotions, contests, sweepstakes, direct marketing, digital/social/mobile media, loyalty programs, and point-of-sale practices
Review and maintain terms & conditions for all customer touch points and services (e.g., websites, loyalty programs, gift cards, coupons, and promotional offers)
Review mobile-applications and experiences
Regulatory
Advise on matters of product development, product labeling and claim substantiation
Work with cross-functional team on issues involving product safety
Support conversations with regulatory authorities
Provide guidance to regulatory team on novel legal matters
Retail Operations
Ensure compliance for receipts, policies, notices, and terms & conditions (e.g., payment cards and return policies)
Provide regulatory guidance for stored value cards/codes (e.g., gift/e-gift cards and reward/promotional cards)
Apply laws governing eCommerce and distance selling
Ensure compliance for digital assistive capabilities in accordance with the Americans with Disabilities Act (ADA) and Canada's The Accessibility for Ontarians with Disabilities Act, 2005 (AODA)
Administer retail-operational compliance programs, such as “Francization” for compliance with Quebec’s Charter of the French language
Privacy and Information Security
Offer supplemental support – specifically, reviewing privacy and information security provisions in commercial contracts
Assist with compliance projects and programs for governing customer and employee data
Address consumer data rights issues
Commercial Contracting
Offer supplemental support – specifically, drafting and negotiating a variety of commercial contracts necessary to support a retail business (ideally with experience negotiating information technology and digital marketing agreements)
Qualifications
QUALIFICATIONS:
6 years of experience in a law firm and/or as in-house counsel
Experience with one or more of the following: (1) compliance with laws governing customer-focused marketing; (2) regulatory matters; (3) retail operations; (4) privacy and information security; (5) information technology and digital marketing contracts
Demonstrated ability to work through retail cross-channel issues
Ability to build relationships and collaborate with cross-functional partners successfully
Strong PC skills; Proficient in use of Microsoft Office applications including Word, Excel, PowerPoint and Outlook
EDUCATION:
Bachelor’s Degree required; Juris Doctor (JD) degree from an accredited law school required
