MTA New York City Transit (NYCT) serves more than 6 million subway customers and 2.3 million bus customers on an average weekday. Its 50,000 employees provide mass transit and paratransit service throughout the five boroughs of New York City, including operating almost 7,000 subway cars at 472 stations.

The NYC Transit Department of Law provides effective legal representation in both litigation and transactional maters and provides in-house counseling to clients. The Department of Law is currently seeking an Executive Assistant General Counsel for the NYCT Workers’ Compensation Division. The selected candidate will report directly to the General Counsel.

The Executive Assistant General Counsel leads and manages the Division’s 60+ examiners, managers, attorneys, medical and billing staff, and assistant directors, and oversees the handling of over 2,400 new workers’ compensation claims each year. The selected candidate must be familiar with workers’ compensation laws, able to manage the litigation of claims before the Workers’ Compensation Board (by in-house attorneys as well as by outside counsel), work effectively with billing and pharmaceutical consultants, manage complex data, and partner with the Special Investigations Unit as well as with the Risk Management Division of the MTA. The chosen candidate should also understand best case management claims handling practices, and be able to assist in the development of training for new staff, including training in new areas of the law, best litigation techniques, and medical management. Further, the position requires the candidate to be able to monitor costs to run an efficient division, in connection with which familiarity with Excel, Power BI, PowerPoint are desirable. The candidate must understand the Medical Treatment Guidelines as well as the new Schedule Loss of Use Guidelines and impacts.

Education and Experience Requirements:

Juris Doctor from an accredited law school; membership in good standing of the Bar of the State of New York, ten (10) years or more experience with Workers’ Compensation claim adjusting at an Insurance Company or Third-Party Administrator, including five (5) years of experience in a managerial or supervisory capacity preferred. Or a satisfactory equivalent of education and relevant experience.

Desired Skills:

  • Strong organization and managerial skills
  • Excellent oral and written communication skills for internal and external contact.
  • Experience adjusting Workers’ Compensation claims in New York.
  • Presentation skills essential to present information, claims, supervisory decisions and recommendations to the legal department.
