一、岗位定位：集团在美国市场处理知识产权及复杂诉讼事务的核心法律专家。

二、核心岗位职责
该岗位的职责围绕美国本土的诉讼攻防展开，以知识产权诉讼为核心，兼顾其他商业纠纷。
1. 知识产权诉讼（主责）作为案件的主要负责人，代理公司处理各类知识产权纠纷，并管理全流程。
- 案件代理：代理美国子公司处理专利、商标、版权、商业秘密等知识产权诉讼案件。
- 全流程管理：主导案件从诉前评估或取证、策略制定、起诉/应诉、证据开示（Discovery）、庭辩到和解谈判的全部环节。
- 外部协同：作为美国公司接口，与国内公司团队协同，有效控制诉讼成本与项目进度。
2. 美国公司其他诉讼纠纷除知识产权外，还需应对美国子公司可能面临的其他类型诉讼。
- 纠纷处理：处理合同/债务类纠纷、劳资纠纷（Employment）、合规类纠纷等非知识产权类诉讼。
- 本地协作：配合美国本地出庭律师（Local Counsel）推进案件审理。
3. 加分项职责以下职责非强制要求，但具备相关能力将极大提升岗位价值。
- 协助国内团队递交商标、专利申请。
- 针对新产品或技术出具自由实施（FTO）分析意见。
- 有美国联邦法院（Federal Court）出庭资格
三、任职资格要求
硬性条件：
- 教育背景与资格：拥有美国法学院JD学位，并已通过伊利诺伊州律师资格考试（Bar Exam） 取得执业资格。
- 工作经验：具备在美国进行知识产权诉讼的实战经验，拥有专利诉讼经验者优先。
- 语言能力：具备中英文双语工作能力，能独立起草专业的英文诉状、动议（Motion）及法律意见书。
优先条件，满足以下任一条件将是加分项：
- 具备美国联邦法院（Federal Court）出庭资格。
- 拥有处理美国国际贸易委员会（ITC）第337条调查或专利审判和上诉委员会（PTAB）专利无效程序的经验。
- 具有美国专利商标局（USPTO）专利代理人（Patent Bar）资格。

Work Location & Flexibility
- Primary Litigation Location: South Dearborn Street, Chicago, IL 60604, USA (Frequent case-handling site).
- Office-Based: We have physical offices in Chicago, New York, and Houston. Attorneys licensed in IL are welcome to work on-site at these locations.
- Remote Option: Remote work is highly acceptable for the ideal candidate, provided they can dedicatedly support the company’s business needs.
Position Overview
As a core legal expert for the group in the US market, you will spearhead intellectual property (IP) matters and manage complex litigation.
- Job Title: Senior IP Litigation Attorney
- Job Type: Full-time
- Bar Admission: Must be admitted to the Illinois State Bar (Active and in good standing)
- Practice Area: Cross-border Litigation / Intellectual Property
- Reporting Entity: US Subsidiary
Core Responsibilities
Your primary focus will be navigating US-based litigation defense and offense, centered on IP litigation, while occasionally managing general commercial disputes.
1. Intellectual Property Litigation (Primary Duty)
Act as the lead counsel managing the entire lifecycle of IP disputes.
- Case Representation: Represent the US subsidiary in litigation involving patents, trademarks, copyrights, and trade secrets.
- End-to-End Case Management: Lead and oversee all stages of litigation, including pre-suit evaluation, evidence collection, strategy formulation, drafting pleadings/answers, managing the discovery process, oral arguments, and settlement negotiations.
- Cross-Border Collaboration: Serve as the primary liaison for the US company, collaborating with our domestic headquarters team to efficiently control litigation costs and project timelines.
2. General Commercial & Corporate Litigation
Handle non-IP disputes that may arise within the US subsidiary.
- Dispute Resolution: Manage contract disputes, debt recovery, labor and employment issues, and regulatory compliance litigation.
- Local Counsel Management: Coordinate and collaborate effectively with local trial counsel when necessary to advance court proceedings.
3. Value-Added Responsibilities (Preferred/Bonuses)
- Assist domestic R&D/legal teams with trademark and patent filings.
- Provide Freedom to Operate (FTO) analysis and legal opinions for new products or technologies.
Qualifications & RequirementsMinimum Qualifications (Must-Haves):
- Education & Credentials: Juris Doctor (J.D.) degree from an ABA-approved law school and active admission to the Illinois Bar.
- Experience: Proven hands-on track record in US IP litigation. Experience in patent litigation is highly preferred.
- Language Proficiency: Professional bilingual fluency in English and Mandarin (written and spoken). Must be fully capable of independently drafting professional English pleadings, motions, and legal opinions, while effectively communicating with cross-border teams.
Preferred Qualifications (Big Plusses):
- Admitted to practice before US Federal District Courts.
- Experience handling Section 337 investigations before the US International Trade Commission (ITC) or patent post-grant proceedings before the Patent Trial and Appeal Board (PTAB).
- Registered USPTO Patent Attorney or Agent (passed the Patent Bar).
