Position Summary
We are looking for a Paralegal who thrives in a fast paced, entrepreneurial growth environment. This individual will support our legal and asset management functions. This role is focused primarily on managing the legal aspects of defaulted loans — working closely with outside foreclosure counsel across multiple jurisdictions — while also supporting the broader lending operation with default loan documentation, lien position review, and collateral oversight. The ideal candidate is organized, proactive, and comfortable operating in a fast-paced, commercial lending environment.
Responsibilities
Loan Documentation & Collateral Review
- Track maturity dates, extension options, and loan modification terms across the active loan portfolio.
- Assist with preparation of loan modification agreements, extension agreements, and forbearance documentation as directed by management or counsel.
Default Monitoring & Pre-Foreclosure
- Coordinate issuance of default notices, demand letters, and cure notices in accordance with loan documents and applicable state law.
- Review and monitor tax liens, municipal liens, HOA liens, judgment liens, mechanic's liens, and other encumbrances impacting collateral recovery.
- Evaluate collateral position and property condition in coordination with asset managers and outside counsel.
- Assist in negotiating and documenting payoff agreements, deed-in-lieu transactions, and workout arrangements under attorney supervision.
Foreclosure Management
- Serve as the primary internal point of contact for outside foreclosure counsel on all referred matters.
- Refer defaulted loans to foreclosure counsel and provide all necessary loan file documentation, collateral information, and borrower data to initiate proceedings.
- Track all foreclosure milestones including Verification of Mortgage, Complaint filing, Service of Process, Motions, Judgments, Sheriff Sale scheduling, foreclosure sales, deed recording, and post-sale actions.
- Review status reports and invoices from outside counsel; escalate issues and delays to management.
- Coordinate with foreclosure counsel on judicial and non-judicial foreclosure proceedings across multiple states.
- Assist with preparation of credit bids, auction logistics, and post-sale documentation
- Manage REO (real estate owned) matters following completed foreclosure, including coordination of deed preparation, title clearance, and property management handoff.
- Prepare weekly foreclosure status reports and lead recurring default review meetings with Asset Management leadership and outside counsel.
Construction Loan Oversight Support
- Coordinate with inspectors, title companies, and counsel on construction loan-related title endorsements and lien waivers.
General Legal & Administrative
- Maintain accurate and up-to-date status reports for all defaulted and referred loans.
- Organize and maintain files, correspondence, and closing documentation.
- Communicate professionally with borrowers, guarantors, outside counsel, title companies, and other third parties.
- Assist management with special projects and legal research as needed.
- Ad hoc projects, as assigned.
Qualifications
- Working knowledge of judicial and non-judicial foreclosure processes; multi-state experience is a strong plus.
- Familiarity with fix and flip, bridge, and light to heavy rehab construction loan structures.
- Familiarity with distressed real estate, REO disposition, and deed-in-lieu transactions
- Understanding of mechanic's lien laws and construction loan title insurance endorsements
- Strong ability to manage a large, active docket with multiple simultaneous matters and deadlines
- Proficiency with Microsoft Office; experience with loan management, construction management, and/or document management software a plus
- Excellent written and verbal communication skills; ability to communicate clearly with outside counsel, borrowers, and internal stakeholders
- High attention to detail, strong organizational skills, and ability to work independently with minimal supervision
- Strong working knowledge of Google Sheets, MS office and Sharepoint.

Education & Experience
- Bachelor's degree or Paralegal Certificate from an ABA-approved program.
- Minimum 3–5 years of paralegal experience, with direct exposure to real estate lending and foreclosure proceedings.
- Experience working for or with a private lender, hard money lender, mortgage company, or real estate law firm strongly preferred.
- Experience coordinating foreclosure referrals across multiple states and foreclosure law firms
- Notary Public commission or willingness to obtain.
