WHAT YOU WILL DO
The Senior Counsel, Privacy and Advisory provides strategic, practical legal guidance across HCA’s core consumer finance, vehicle voluntary protection products, and emerging mobility businesses. This role oversees legal compliance for marketing activities—including advertising, digital marketing, consumer and dealer communications, and applicable marketing laws and industry standards—and advises on federal and state privacy, information security, advertising, and consumer protection requirements. The Senior Counsel also designs, implements, maintains, and continuously improves HCA’s enterprise privacy framework, including privacy-related policies, procedures, standards, and governance processes. In addition, this role leads attorneys and privacy and records management governance professionals while serving as a key advisor to senior stakeholders on privacy risk, regulatory developments, privacy-by-design principles, and product, technology, and business initiatives.
HOW YOU WILL MAKE AN IMPACT
Act as the Company’s primary privacy SME, providing legal and strategic guidance to business, technology, product, and operations teams to ensure compliance with applicable privacy, data protection, information security and consumer protection/advertising laws. Oversee legal review of all external communications to consumers, customers and dealers.
Own, implement, and maintain the Company’s enterprise privacy framework, including privacy policies, standards, procedures, governance models, and internal guidance. Lead updates to the privacy framework in response to regulatory developments, enforcement trends, and evolving business practices. Oversee privacy-related documentation, recordkeeping, and reporting.
Act as primary liaison with Company’s affiliates in various data sharing, privacy, and marketing-related initiatives. Support new and existing third-party contract negotiations to identify and address privacy, data protection, information security and records management requirements.
Lead, mentor, and develop team members by providing direction, performance feedback, and support to ensure effective collaboration, professional growth, and achievement of organizational and personal goals.
Qualifications
WHAT YOU WILL BRING TO THE ROLE
Minimum 8 years of relevant legal experience in providing legal and strategic guidance on product and process development, with a focus on privacy, information security and advertising/consumer protection.
Minimum 3 years supervisory experience.
In-house legal experience preferred.
Consumer financial services or automobile finance strongly preferred.
Juris Doctor Degree; member in good standing of a state bar (CA preferred).
CIPP certification a plus.
Broad-based experience and knowledge in privacy and information security laws and experience in providing practical and actional guidance in product development and process changes.
Willingness to undertake substantial and diverse job responsibilities.
Ability to work independently and as part of legal and business teams.
Ability to effectively manage team members to ensure performance and alignment with Company objectives.
Ability to quickly pivot to changing business priorities.
Willingness to explore and identify creative alternative solutions to facilitate business initiatives.
Broad-based knowledge of privacy laws and regulations, both financial services-related and general consumer protection.
Broad-based knowledge of consumer financial services.
Ability to communicate in clear and concise manner; ability to communicate complex legal issues in laymen’s terms to all levels of the organization.
Ability to research in a thorough and effective manner and to analyze and distill complex legal requirements into a usable and practical framework.
Ability to successfully manage, train, develop and mentor direct reports.
