JOB DESCRIPTION:

Primary Purpose: Provide in-house legal support services to the Superintendent and designated staff. Advise the Superintendent regarding legal performance of duties

RESPONSIBILITIES:

Major Responsibilities and Duties
Legal Representation

Advise the superintendent and staff on legal matters, including personnel and student issues and compliance with the Public Information Act.

Draft, review and revise legal documents, rules and regulations, resolutions, applications of diverse kinds, inter-local agreements, and all other legal or quasi-legal papers as needed.

Attend Board meetings and other administrative meetings to provide legal counsel.

Accept and respond to notices of claims and demands against the District.

Provide advice to the appropriate district representatives regarding all matters of student discipline involving suspensions and student appeals for the purpose of ensuring all laws, regulations and policies are followed.

Handle complaints, hearings and litigation related to Special Education (or delegating the same to staff or outside counsel).

Coordinate legal services provided by outside law firms.

Monitor and handle cases assigned to outside legal counsel.

Serve as the district’s hearing officer for applicable student and employee grievances, complaints, and appeals as required by policy.

Assist campuses and departments in day-to-day operations to identify and manage potential legal issues early.

Negotiate and draft contracts for the acquisition of real and personal property, the employment of architects, contract management firms, contractors, and other entities.

Legal Oversight

Comply with policies established by federal and state law, State Board of Education rule, and local board policy and serve as the district’s compliance officer.

Monitor and interpret the impact of proposed or enacted legislation.

Request advice and information from governmental agencies and regulatory bodies, as needed.

Coordinate responses to investigations by the Texas Education Agency, U.S. Department of Education Office for Civil Rights, and other administrative, regulatory agencies, or law enforcement agencies.

Monitor compliance with the Texas Open Meeting Act and competitive procurement and purchasing requirements.

Coordinate and oversee timely compliance with subpoenas, including subpoenas for student records, employee records or other types of records.

Provide legal assistance on district elections.

Policy and Reports

Assist in the formulation and execution of policies and regulations, and review materials for publication in handbooks.

Compile, maintain, file, and present all reports, records, and other documents as required.

Follow district safety protocols and emergency procedures.

Communication

Conduct professional development and training, including preparing training materials for staff.

Other

Perform other duties as assigned.

Supervisory Responsibilities:

Supervise and evaluate the work of assigned support staff

EXPERIENCE:

Minimum Experience:

Seven years of experience in public or private practice dealing with legal issues of local, state, federal government, or public school law preferred
Experience in Special Education law preferred

QUALIFICATIONS:

Minimum Education/Certification:

Law degree from an American Bar Association approved law school
Licensed to practice law in the State of Texas, in good standing

Special Knowledge/Skills:

Specialized knowledge in Special Education law
Knowledge of local, state, and federal laws, regulations relating to public education
Demonstrated legal research and writing skills
Thorough knowledge of the legislative process
Ability to read and interpret documents such as law, policy, and procedures
Ability to communicate effectively in both written and oral forms with all levels of management, both internal and external to the district
Excellent public relations, organizational, communication, and interpersonal skills

Working Conditions
Mental/Physical Demands/Environmental Factors:
Prolonged sitting; occasional bending/stooping, pushing/pulling, and twisting; repetitive hand motions including frequent keyboarding and use of mouse; occasional reaching; occasional light lifting and carrying (less than 15 pounds).

Frequently work prolonged or irregular hours, frequent district-wide travel, works with frequent interruptions, maintain emotional control under stress.
