Position Overview
Brabeion Academy seeks an experienced Special Education Director Consultant to provide ongoing legal, strategic, and programmatic guidance to our special education team. This is an independent contractor engagement structured as a monthly retainer. The successful candidate will not be responsible for direct service delivery but will serve as a senior advisor to qualified on-site SPED staff, equipping them to operate with legal precision, programmatic integrity, and institutional confidence.
Scope of Work
The consultant will:
- Review incoming and existing IEPs with SPED staff, providing legal and programmatic analysis grounded in current IDEA requirements
- Serve as a standing member of the IEP team, attending meetings remotely as warranted by the complexity of individual cases
- Advise staff on day-to-day compliance questions, eligibility determinations, and procedural safeguards
- Guide the school's approach to Least Restrictive Environment (LRE) analysis, including developing well-reasoned documentation when the school's environment may not represent the LRE for a given student
- Build staff capacity to conduct independent evaluations, engage families appropriately, and manage IEP processes with confidence
- Advise on transfer student IEP review procedures, comparable services determinations, and FAPE obligations under IDEA
- Assist in developing school-wide SPED policies and procedures consistent with Idaho law and IPCSC requirements
- Support the school in limiting legal exposure through proactive compliance posture and accurate documentation practices
Required Qualifications
- Minimum of 7 years served as a Special Education Director in a public certified environment; general special education experience does not substitute for this requirement
- Terminal degree in Special Education required: EdS, EdD, or PhD in Special Education or a closely related field
- Current or prior Special Education Director credential (or state equivalent); credential must be documentable
- Deep working knowledge of IDEA 2004, including FAPE standards as clarified by Endrew F. v. Douglas County School District (2017), LRE requirements, procedural safeguards, and transfer student provisions
- Demonstrated ability to distinguish between legal obligation and advocacy position, and to communicate that distinction clearly to staff
- Track record of building legally defensible IEP documentation and compliance practices
- Alignment with a conservative educational philosophy and comfort working within a school whose core academic program is American Experience featuring Hillsdale 1776
Preferred Qualifications
- Juris Doctor (JD) with specialization in special education law, or significant formal legal training specifically in IDEA, special education due process, and disability rights; general education law experience alone does not satisfy this preference; candidates with a qualifying JD will be given strong preference
- Experience supporting start-up or first-year public schools through the SPED program development process
- Familiarity with Idaho special education regulations and the Idaho Public Charter School Commission
- Experience in due process proceedings, administrative hearings, or litigation support
- Prior consulting or independent contractor experience
Compensation
This is an independent contractor position. Compensation is structured as follows:
- Hourly Rate: $50-$150 per hour, depending on experience and qualifications
- Retainer: A prepaid retainer of 25-50 hours is due at contract commencement
- Engagement is ongoing month-to-month with retainer renewal terms established in the contract
Candidates seeking compensation at the top of the range should hold a Juris Doctor with specialization in special education law, have served as a special education director for 10 or more years, and possess a terminal degree in special education. Qualifications must be documentable.
