Position Summary & Responsibilities
The Civil Division houses attorneys in three sections: Defensive Litigation, Affirmative Civil Enforcement (ACE), and Legal Oversight & Government Counsel (LOGiC). A position is currently available in Affirmative Civil Enforcement (ACE), Defensive Litigation and Legal Oversight & Government Counsel (LOGiC) sections.
Affirmative Civil Enforcement (ACE): Attorneys in this section litigate cases where the State will appear as the plaintiff, affirmatively asserting and protecting State interests. This practice involves a wide range of plaintiff-oriented cases such as false claims, breach of contract, illegal annexations, enforcement actions on behalf of the State of Kansas, representing state agencies in administrative disciplinary/licensing matters, ensuring Kansas’ compliance with the Tobacco Master Settlement Agreement (MSA), and pursuing judgments on behalf of the state. The Assistant Attorney General will litigate cases with a team with other attorneys, one special agent, and administrative support professionals.
Defensive Litigation: Attorneys in this section defend the State of Kansas and its agencies in all manner of defensive litigation: torts, employment suits, prisoner litigation, wrongful conviction claims, contract disputes, civil rights claims, appeals from administrative decisions, and a host of other civil claims. They handle cases all the way through motions practice, discovery, settlement negotiations, and trial as necessary.
Legal Oversight & Government Counsel (LOGiC): Attorneys in this section provide general counsel services to various agencies, boards, and commissions throughout Kansas. In addition to providing legal advice on personnel matters and open government compliance, this role involves attending board/commission meetings, assisting boards in administrative hearings, and drafting orders as necessary. LOGiC attorneys also review and approve all of the state’s regulations, and many state bonds, contracts, property transactions, and interlocal agreements. LOGiC attorneys must have the ability to learn and understand not only employment, open government, and state finance law, but also the unique statutory and regulatory authorities that apply to our client agencies.
Duties:
Drafting/arguing pleadings and motions; investigating potential cases; interviewing clients and witnesses; legal research and writing; conducting depositions; conducting negotiations; participating in administrative hearings; district court trial advocacy; researching, interpreting, and applying statutes, court decisions, or other legal authority on points of law; and overseeing personal case management.

Travel: Infrequent to occasional travel both within and outside the state of Kansas for meetings, depositions, hearings, trials, training, and other investigation- and litigation-related duties will be required.
