Job Overview
We are seeking a dynamic, detail-oriented, and leadership-ready Pre-Litigation Personal Injury Attorney to join our dedicated California legal team. In this role, you will be primarily responsible for managing personal injury claims from inception through pre-litigation stages, ensuring thorough case evaluation, effective client communication, and strategic resolution efforts.
Beyond managing your own docket, you will play a critical role in firm risk management and quality control. Utilizing Salesforce, you will oversee and audit our team of case managers, ensuring files are moving efficiently, tasks are completed, and approaching Statutes of Limitations (SOL) and California Government Claim deadlines are strictly monitored and protected. Additionally, you will support our litigation department as needed, which includes drafting and filing complaints, handling occasional court appearances, and preparing clients for depositions.
Responsibilities
- Team Leadership & Case Auditing: Oversee and audit a team of case managers and their respective files using Salesforce. Ensure tasks are assigned and completed, cases are moving efficiently through the pipeline, medical records are requested timely, and firm protocols are strictly followed.
- California SOL & Deadline Risk Management: Vigilantly monitor firm workflows and calendars for approaching California Statutes of Limitations (including the strict 6-month Government Claim deadlines). Proactively transition cases from pre-litigation to litigation and ensure timely lawsuit filings.
- Pre-Litigation Management: Review and analyze California traffic collision reports, injury claims, medical records, and relevant documentation to determine liability and assess damages.
- Legal Writing & Demands: Draft detailed demand letters, policy-limit demands, settlement proposals, and legal correspondence that clearly articulate case positions.
- Litigation Support & Hearings: Draft and file complaints in California Superior Courts, handle discovery compliant with the California Code of Civil Procedure (CCP), and attend court hearings (including Case Management Conferences and motion hearings) when required.
- Deposition Preparation: Meet with clients to thoroughly prepare them for upcoming depositions, ensuring they understand the process, feel confident, and are protected under CA deposition guidelines.
- Calendar & Jurisdiction Management: Successfully navigate complex scheduling demands, including managing back-to-back or conflicting hearings across different county superior courts, coordinating remote court appearances (e.g., via CourtCall/LACC) or coverage when necessary.
- Client & Adjuster Negotiations: Negotiate effectively with insurance adjusters and defense counsel to secure favorable resolutions.
Qualifications
- Education & License: Juris Doctor (JD) degree from an accredited law school with an active, good-standing admission to the State Bar of California (essential).
- California PI Experience: Proven experience in California personal injury law with a deep understanding of both the pre-litigation pipeline and the CA civil litigation filing process.
- Software Proficiency: Hands-on experience with Salesforce (or similar legal case management software).
- Management & Leadership Skills: Prior experience managing, mentoring, or auditing case managers, paralegals, or legal assistants is a strong plus.
- Meticulous Attention to Detail: A hyper-focused approach to tracking workflows, tasks, and deadlines (specifically CA SOLs and Government Claims).
- California Civil Procedure Familiarity: Solid understanding of the California Code of Civil Procedure (CCP), drafting complaints, handling discovery, and appearing at court hearings.
- Adaptability & Time Management: Exceptional organizational skills with the ability to remain calm and resourceful when managing tight deadlines, conflicting schedules, or multi-jurisdictional demands.
Pay: $90,000.00 - $120,000.00 per year
