REQUEST FOR PROPOSALS FOR ZONING AND CODE ENFORCEMENT OFFICER/THIRD-PARTY ZONING AND CODE ENFORCEMENT

is seeking requests for proposals for the position of Zoning and Code Enforcement, to be held by an individual or third-party. Proposals will be opened at the Borough Council meeting on June 17, 2026, at 6:30 p.m.

Zoning and Code Enforcement Officer/ Third-Party Zoning and Code Enforcement

Position Summary
The Borough of West Pittston seeks a qualified professional/professional service to serve as the Zoning and Code Enforcement Officer. This position is responsible for administering and enforcing the Borough’s zoning ordinance, property maintenance standards, and applicable municipal codes and ordinances, including but not limited to, the Pennsylvania Municipalities Planning Code (MPC), the International Property Maintenance Code (IPMC), and other applicable state and local regulations. This position performs professional, technical, administrative, inspection, and enforcement work involving land use regulation, development review, property maintenance enforcement, permitting, inspections, public education, and coordination with municipal boards, commissions, contractors, residents, and outside agencies. The position is appointed by Borough Council and shall not hold any elected office within the Borough.
Essential Duties and Responsibilities
Zoning Administration and Enforcement
- Administer and enforce the Borough Zoning Ordinance in accordance with its literal terms and the Pennsylvania Municipalities Planning Code (MPC).
- Receive, review, approve, deny, and issue zoning permits and related applications where compliance with the zoning ordinance has been established.
- Ensure no construction, alteration, use, or change of use is permitted that does not conform to the zoning ordinance.
- Review applications for: conditional uses, special exceptions, variances, subdivision and land development applications, contractor registration, solicitation, pave cuts, dumpster permits, firework permits, and handicap parking permits
- Provide written comments and recommendations to Borough Council, the Planning Commission, and the Zoning Hearing Board, as needed or requested.
- Participate in hearings and provide testimony, records, maps, and information, as required.
- Maintain and update official zoning maps, overlay districts, and zoning records.
- Make zoning district and zoning boundary determinations upon request.
- Issue Certificates of Zoning Compliance and Certificates of Nonconformity as required.
- Identify, document, and maintain records of nonconforming uses and structures.
- Process enforcement actions for zoning violations, including notices of violation, stop work orders, permit revocations, summary citations, court documentation, and testimony
- Maintain complete records of all zoning permits, applications, inspections, complaints, enforcement actions, and hearing proceedings.
- Coordinate scheduling, advertising, posting, and public notice requirements for hearings and applications as needed or required.
- Upon request, issue preliminary opinions under Section 916.2 of the Pennsylvania Municipalities Planning Code.
- Revoke permits issued in error, by mistake of fact, or based upon false or misleading information.
- Issue certificates, permits, notices, and orders in accordance with Borough ordinances and applicable regulations.
Property Maintenance and Code Enforcement
- Administrate and enforce the International Property Maintenance Code (IPMC), Borough nuisance ordinances, and applicable code enforcement regulations.
- Conduct inspections of residential, commercial, industrial, and vacant properties to determine compliance with applicable codes and ordinances.
- Investigate complaints involving property maintenance violations, tall grass and weeds, snow and ice removal, unsafe structures, exterior property conditions, nuisances, and sanitation concerns
- Issue notices of violation, correction notices, stop work orders, citations, and enforcement orders.
- Coordinate enforcement actions with the Borough Solicitor, Police Department, Fire Department, and other agencies, as necessary.
- Maintain detailed records of inspections, enforcement actions, notices, photographs, correspondence, and case files.
- Prepare documentation and testimony for hearings, citations, and court proceedings.
- Order the repair, securing, vacation, or demolition of unsafe or dangerous structures where authorized by law, ordinance, and Borough Council
- Conduct periodic and systematic inspection programs throughout the Borough.
- Enforce non- building code property maintenance regulations related to weeds, rubbish, sidewalks, snow and ice removal, and similar nuisance conditions.
Public Relations and Administrative Duties
- Provide information and technical assistance to residents, contractors, developers, property owners, engineers, surveyors, and businesses regarding zoning, permitting, and code enforcement matters.
- Prepare written reports, correspondence, enforcement notices, and recommendations for Borough Council, boards, commissions, and legal proceedings.
- Attend Borough Council, Planning Commission, Zoning Hearing Board, and other meetings as required.
- Maintain confidentiality and professionalism while interacting with the public.
- Coordinate with county, state, and local agencies regarding regulatory compliance matters.
Minimum Qualifications
- Property maintenance and/or code enforcement certifications.
- Demonstrated working knowledge of:
- Certified Zoning Officer (CZO)
- Pennsylvania Municipalities Planning Code (MPC)
- International Property Maintenance Code (IPMC)
- Municipal code enforcement procedures
- Zoning Hearing Board procedures
- Variances and special exceptions
- Experience in zoning administration, code enforcement, planning, inspections, construction, or municipal government preferred.
- Ability to read and interpret ordinances and legal documents, maps and surveys, site plans and engineering drawings, construction documents, and permit applications
- Strong written communication, recordkeeping, organizational, and public interaction skills.
- Experience with GIS mapping systems and municipal permitting software.
- Experience presenting testimony before boards, commissions, district judges, or courts.
- Prior municipal government experience preferred.
- Valid Pennsylvania driver’s license required.
Fees
All Fees charged to applicants are set by the Borough Fee Schedule, collected by the Borough, and kept by the Borough.
No inspections are to be performed until fees are paid in full to the Borough, and the Secretary has confirmed such.
Working Conditions
Individuals applying for this position will be required to maintain regular office hours, as agreed upon between the Borough and the applicant. Preference will be given to third-party applicants that offer set office hours.
Work is performed in both office and field settings. Duties require frequent site inspections in varying weather conditions and may involve exposure to construction sites, damaged structures, uneven terrain, and other potentially hazardous conditions.
The position may require attendance at evening meetings, court proceedings, and emergency response activities related to unsafe structures or nuisance conditions.
Appointments shall be made directly between the applicant and the officer, who will submit monthly reports and maintain a shared calendar.
The officer must maintain professional objectivity, confidentiality, and impartial enforcement practices.
The officer shall report to and work with the Borough Manager and Secretary.
Compensation
The salary for an individual applying for this position shall be $35,000-$45,000 dependent upon experience, plus benefits for qualified applicants. Third-party applicants will be reimbursed based on a submitted monthly invoice.
