Commercial Title Insurance Counsel/Underwriter is responsible for underwriting complex commercial real estate title insurance transactions while providing legal analysis and risk assessment. This role partners closely with internal teams, customers, lenders, developers, and legal counsel to structure and facilitate large and sophisticated commercial deals. The ideal candidate combines strong legal expertise with underwriting experience and a client-focused mindset.
Responsibilities
Underwriting & Risk Management
- Evaluate and underwrite commercial title insurance risks for complex real estate transactions, including multi-state and high-liability deals
- Analyze title commitments, surveys, legal descriptions, and supporting documents to determine insurability
- Structure and draft endorsements and policy coverage to meet transaction requirements
- Assess and articulate risk exposure, ensuring compliance with underwriting guidelines and company standards
- Provide approval for high-liability transactions within authority limits and collaborate on escalated files
Legal & Transactional Support
- Provide legal interpretation of title issues including easements, covenants, restrictions, liens, and encumbrances
- Review and advise on purchase agreements, loan documents, and closing structures related to title matters
- Draft or review indemnity agreements and other risk mitigation tools
- Resolve complex title defects and collaborate with attorneys to clear title issues
Client & Business Development Support
- Serve as a trusted advisor to customers, including attorneys, lenders, developers, and internal stakeholders
- Communicate underwriting decisions clearly and provide solutions-oriented guidance
- Support business development by participating in client meetings, presentations, and strategic initiatives
- Build and maintain strong relationships to support retention and growth
- Partner with escrow, closing, and sales teams to ensure timely and accurate transaction processing
- Provide mentorship and technical guidance to junior underwriters and staff
- Stay current on regulatory requirements, underwriting practices, and market trends
