Position Overview
We are seeking an experienced Of Counsel to lead and strengthen our eminent domain practice. The Of Counsel will manage high-stakes takings and condemnation matters, provide strategic legal advice to public- and private-sector clients, and litigate complex cases at trial and on appeal. This role requires a seasoned litigator with a Juris Doctor, proven Eminent Domain expertise, and a track record of producing results while mentoring junior lawyers and contributing to business development.
Key Responsibilities

Serve as lead counsel on eminent domain and condemnation matters in state and federal courts, handling all phases of litigation from pleadings through trial and appeal.

Develop case strategy, evaluate claims and exposures, and advise clients on valuation, acquisition risk and mitigation, and settlement options.

Draft and litigate dispositive motions, motions in limine, jury instructions, briefs for trial and appellate courts, and other substantive pleadings.

Manage discovery, coordinate with expert appraisers, engineers and surveyors, and prepare and defend expert testimony.

Negotiate settlements, orchestrate takings valuations and acquisition processes, and pursue alternative dispute resolution when appropriate.

Supervise, mentor and train associates and paralegals; provide constructive feedback and oversee quality control of legal work product.

Maintain and cultivate client relationships, participate in business development and client pitches, and contribute to practice growth.

Ensure compliance with professional and ethical obligations, manage case budgets and billing, and oversee docket and case management tasks.
Qualifications

Juris Doctor (JD) from an accredited law school and active admission to the state bar (eligible to practice in relevant jurisdiction).

Minimum of 7+ years of litigation experience with a substantial focus on Eminent Domain/condemnation matters; prior Of Counsel or senior associate experience preferred.

Proven courtroom experience including trials and appellate practice; strong track record of handling complex takings litigation.

Demonstrated expertise in litigation skills: motion practice, discovery management, witness preparation, and persuasive legal writing.

Experience working with valuation experts (appraisers, economists), engineers and land-use professionals.

Excellent client-facing skills, business development aptitude, and the ability to build and maintain client trust.

Strong leadership and mentorship abilities with experience supervising junior lawyers and support staff.

Willingness to travel as needed for hearings, trials, depositions and client meetings.
