Company Overview: We are a $2B real estate company operating 270 properties in 40 states specializing in mobile home park property acquisition, leasing, and management. We are seeking a proactive and business-minded In-House Counsel to join our team and provide solution-driven strategic legal guidance to support our national operations with a focus on California matters.
Position Summary: The In-House Counsel will serve as a trusted legal advisor to the owner and business leaders overseeing a broad range of real estate, litigation, mobile home residency law, unlawful detainer, corporate, regulatory, and employment matters. This role requires strong knowledge of real estate law, contracts, and compliance, as well as the ability to balance legal risk with business objectives. This position will be primarily an in-person position at our North Sacramento office.
This role's core focus involves personally handling California litigation, eviction matters from pre-filing through judgment, contract review, real estate transactions, and the myriad of issues that come up in a growing business. Your will coordinate with outside counsel as assigned by insurance carriers handling general liability issues.
Key Responsibilities:
Unlawful Detainer
· Manage a caseload of unlawful detainer matters from intake through resolution
· Draft and review notices (e.g., 3-day, 30/60-day notices) and pleadings
· Appear in court for hearings, trials, and motion practice
· Coordinate outside counsel for remote appearances.
· Communicate effectively with managers to provide clear, practical legal guidance
Real Estate Transactions & Operations
· Review purchase and sale agreements, leases, easements, and related real estate contracts.
· Provide legal oversight for property acquisitions, dispositions, financing, and development projects.
· Advise on title, zoning, land use, and permitting issues.
· Oversee compliance with fair housing laws, ADA, and other applicable real estate-related statutes.
Litigation, Risk Management & Dispute Resolution
· Manage and resolve legal disputes, litigation, and administrative proceedings. Defend and initiate various claims, utilizing outside counsel as needed.
· Advise leadership on risk mitigation strategies for contracts, operations, and new initiatives.
Employment & Labor Law Support
· Advise HR on employment law compliance, employee relations, and workplace policies across multiple states.
· Assist with investigations, employee agreements, and terminations.
Contract Management
· Oversee negotiation and review of vendor, service, and construction agreements.
· Implement contract management processes to streamline workflows and reduce legal risk.
Cross-Functional Legal Support
· Collaborate with finance, operations, HR, and development teams to provide practical legal solutions.
· Participate in negotiation and review of vendor, service, and construction agreements.
· Deliver training to staff on legal topics such as contract compliance, fair housing, and ethics.
Qualifications:
· Active membership in the California State Bar
· 5+ years of legal experience, with at least 2 years Landlord-Tenant matters.
· Experience in landlord–tenant law, real estate litigation, or civil litigation preferred
· Familiarity with unlawful detainer procedures strongly preferred
· Strong drafting, analytical, and courtroom skills
· Ability to manage multiple matters efficiently in a fast-paced environment
