About the Position
We are seeking an experienced Real Estate Litigation Attorney with 5+ years of experience to join our growing legal team in Plano, Texas. The ideal candidate will have extensive experience handling commercial real estate litigation, creditor rights, foreclosure matters, debt collection, loan enforcement, and complex real estate disputes while also supporting transactional real estate matters. This position offers the opportunity to work on sophisticated commercial real estate matters representing developers, investors, lenders, landlords, property owners, and business clients.
Responsibilities
As a Real Estate Litigation Attorney, you will:
Commercial Real Estate
- Provide legal support on commercial real estate transactions, including acquisitions, sales, financing, leasing, and development projects.
- Draft, review, and negotiate purchase agreements, commercial leases, loan documents, easements, financing documents, and development agreements.
- Conduct legal due diligence, including title review, survey review, zoning analysis, regulatory compliance, and risk assessment.
- Advise clients on commercial real estate development, asset acquisitions, financing, and portfolio management.
Litigation & Dispute Resolution
- Handle litigation involving commercial real estate disputes, breach of contract claims, lease disputes, foreclosures, loan defaults, title disputes, construction-related matters, and debt collection.
- Represent clients in Texas state and federal courts, as well as mediations, arbitrations, and settlement negotiations.
- Develop litigation strategies and manage cases from pre-suit through trial and appeal when necessary.
- Draft and review pleadings, motions, discovery requests and responses, settlement agreements, legal memoranda, appellate documents, and regulatory filings.
- Coordinate with clients, outside counsel, title companies, lenders, and other stakeholders throughout the litigation process.
- Assist with enforcement of judgments through garnishments, liens, writs of execution, receiverships, and other post-judgment remedies.
- Advise clients on dispute resolution strategies, collections, creditor rights, and asset protection.
Compliance & Risk Management
- Ensure compliance with applicable federal, Texas, and local laws and regulations, including the Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), and other real estate and lending regulations.
- Identify legal risks and provide proactive recommendations to minimize litigation exposure.
- Monitor changes in real estate, lending, foreclosure, and collection laws and advise clients accordingly.
Qualifications
Required
- Juris Doctor (J.D.) from an ABA-accredited law school.
- Active member in good standing of the State Bar of Texas.
- Minimum 5 years of experience in commercial real estate litigation and related legal matters.
- Strong experience handling commercial litigation in Texas state and federal courts.
- Experience with foreclosure, loan enforcement, debt collection, creditor rights, and post-judgment remedies.
- Excellent drafting skills for pleadings, motions, discovery, settlement agreements, and transactional documents.
- Strong analytical, negotiation, legal research, and communication skills.
- Ability to independently manage a high-volume caseload while maintaining exceptional client service.
Preferred Qualifications
- Experience representing commercial property owners, developers, lenders, investors, and financial institutions.
- Knowledge of commercial real estate transactions and financing.
- Trial, arbitration, and mediation experience.
- Existing client relationships or a portable book of business is a plus.
- Board Certification in Commercial Real Estate Law or Civil Trial Law is a plus.
