Position Overview
We are seeking a detail-oriented Pre-Litigation Attorney with a focus on personal injury matters to manage pre-suit case development, client counseling, and settlement negotiations. The ideal candidate will evaluate liability and damages, coordinate investigations, negotiate with insurers and opposing counsel, and prepare cases for litigation when necessary. This role requires strong advocacy, excellent client communication, and the ability to move cases efficiently from intake to resolution.
Key Responsibilities

Manage the full pre-litigation lifecycle for personal injury matters, including intake, factual investigation, damages assessment, and case strategy development.

Conduct thorough case evaluations and liability analyses using medical records, accident reports, witness statements, and other evidence.

Draft and serve demand letters, correspondence, pre-suit pleadings, and other legal documents required to advance claims toward resolution.

Negotiate settlements with insurance adjusters and opposing counsel to obtain fair and timely recoveries for clients.

Communicate regularly with clients to provide case updates, explain legal options, and advise on settlement decisions and expectations.

Coordinate and supervise investigators, medical experts, and other vendors to build a persuasive pre-suit record.

Review and analyze insurance policies, coverage issues, and client contracts as they affect case exposure and recovery potential.

Prepare files and memoranda to support litigation readiness, including chronology of events, exhibits, and witness interviews when a case proceeds to suit.

Maintain organized case files, track deadlines, and ensure compliance with statutes of limitations and procedural requirements.

Collaborate with litigation attorneys to transition files to court when necessary and support trial preparation as needed.
Qualifications

2+ years of experience handling personal injury matters with demonstrable pre-litigation experience.

Proven ability in case evaluation, liability analysis, and settlement negotiations in personal injury or related tort practice.

Strong knowledge of insurance claims handling, coverage analysis, and experience dealing with insurance adjusters.

Excellent written and oral communication skills, including drafting demand letters, settlement agreements, and persuasive correspondence.

Demonstrated legal research and analytical skills to evaluate statutes, case law, and regulatory issues affecting pre-suit strategy.

Client-focused approach with strong interpersonal skills and the ability to counsel injured clients compassionately and clearly.

High level of organization, time management, and ability to manage multiple files and deadlines simultaneously.
