Who You Are
You're a health law attorney — practicing, recently retired from a firm, or intentionally building a fractional consulting practice. You've spent years inside the regulatory frameworks that govern what health and wellness companies can say, sell, and do: FDA supplement compliance under DSHEA, FTC health claim enforcement, HIPAA, and the scope-of-care boundaries that medical practices have to stay within.
You know this space well enough to spot the problem in a marketing headline before it goes live. You can read a supplement label, a patient intake form, or a service page and immediately see what's compliant, what's borderline, and what will get a company in trouble. You can explain that clearly to a leadership team that isn't made of lawyers, and you're comfortable doing it without a team of associates behind you.
What you're not looking for is another full-time position or a large institutional compliance role. You want to apply your expertise where it actually matters — at a company with a real mission and leadership that takes compliance seriously — on a schedule that works for you. A project-based engagement where you're called in as needed, not on a set hourly schedule, is exactly what you want.

bVital is a regenerative medicine and wellness practice in Park City, Utah offering IV therapy, brain regeneration protocols, and clinically developed supplement programs. We operate at the intersection of innovative medicine and consumer health, which means we take regulatory compliance seriously across everything we do: how we market our services, how we handle patient data, how we position our supplement products, and how we ensure our clinical operations stay within appropriate scope. We're bringing this expertise in-house because we want a trusted advisor who knows our business, not a law firm that bills by the hour for every question.
The Role
This is a project-based consulting relationship, not a part-time job. There are no set hours. We come to you when something needs legal eyes — a new marketing campaign before it launches, a vendor agreement, a question about a clinical protocol, a label review before a product goes live. You review, advise, and flag. You may also surface things we haven't thought to ask about.
The volume will grow as the business grows and as we get comfortable working together. For the right attorney, this becomes an ongoing relationship with a client they believe in.
Marketing and Advertising Compliance
- Review marketing materials, website content, social media, and ad copy to ensure health and treatment claims comply with FTC and FDA guidelines before publication.
- Advise on permissible language for supplement and medical service claims.
- Establish a lightweight review process so content clears legal before it goes live.
HIPAA and Patient Data Privacy
- Assess current HIPAA compliance practices across patient intake, records management, and data handling.
- Review vendor and partner agreements for appropriate data privacy provisions.
- Advise on patient consent processes and documentation standards.
FDA Supplement and Product Compliance
- Review supplement product labeling, claims, and documentation for FDA compliance under DSHEA.
- Advise on permissible structure/function claims.
- Flag ingredients or formulations that warrant NDI notification or additional scrutiny.
Medical Practice and Scope of Care
- Advise on the regulatory boundaries of treatments, protocols, and provider representations to ensure clinical operations stay within appropriate legal and professional scope.
- Review patient-facing materials and provider communications for language that could create liability or trigger regulatory scrutiny.
- Flag emerging areas of risk as the clinic's service offerings evolve.
Who Thrives Here
Must-haves:
- J.D. with active bar admission (or recently inactive) and a practice background in health law, FDA/FTC regulatory, or healthcare compliance
- Working knowledge of HIPAA, FTC health claim enforcement, DSHEA, and medical practice regulatory frameworks
- Experience advising clients or employers on health and wellness regulatory matters — not just researching the law, but making the call
- Able to give clear, direct guidance to a non-legal team: not just \"here's the risk,\" but \"here's what to do\"
- Comfortable working independently without institutional infrastructure
Bonus points:
- Experience advising direct-to-consumer health companies, supplement brands, or medical practices on marketing compliance
- Background in integrative, functional, or regenerative medicine regulatory environments
- Familiarity with state-specific medical practice laws in Utah or multi-state telehealth compliance
- Prior fractional, consulting, or outside counsel experience

Role Logistics
