Position Overview
We are seeking a skilled Bankruptcy and Creditors' Rights Attorney to join our litigation team. The attorney will counsel and represent creditors, creditor committees, and commercial clients in bankruptcy cases and related litigation. The role focuses on protecting creditor interests, prosecuting and defending adversary proceedings and contested matters, and advising clients on restructuring, asset recovery, and enforcement strategies under the Bankruptcy Code.
Key Responsibilities

Represent creditors and creditor committees in Chapter 7, 11 and 13 cases, including contested hearings and plan confirmation matters

Draft and file pleadings, motions, objections, proofs of claim, adversary complaints, settlement agreements and disclosure statements in bankruptcy court

Conduct factual and legal research, prepare memoranda and legal briefs on complex Bankruptcy Code and related commercial law issues

Manage discovery, take and defend depositions, prepare witnesses, and participate in hearings and trials in federal bankruptcy and district courts

Develop and implement strategies for asset recovery, lien enforcement, claim litigation, and enforcement of court orders

Advise commercial clients on restructuring alternatives, workouts, forbearance agreements, and creditor remedies

Negotiate resolutions, settlements, and stipulations with opposing counsel, trustees, and debtors

Collaborate with partners, practice teams and outside counsel to support business development, client intake, and matter budgeting

Maintain up-to-date knowledge of bankruptcy rules, case law and practice trends and provide training or guidance to junior attorneys and staff
Qualifications

Juris Doctor (JD) from an accredited law school and active membership in good standing with Illinois state bar

6+ years of litigation experience with significant exposure to bankruptcy and creditors rights matters; commercial litigation experience preferred

Proven experience representing creditors, creditor committees or lenders in bankruptcy courts and handling adversary proceedings and contested matters

Strong legal research, analytical and legal writing skills, including drafting complex motions and appellate briefs

Demonstrated courtroom experience, including hearings, trials, and oral argument in bankruptcy or commercial litigation

Ability to manage multiple matters and deadlines, mentor junior attorneys, and work effectively in team-oriented and client-facing environments

Excellent negotiation, client counseling and interpersonal skills tailored to creditor-side representation

Familiarity with Bankruptcy Code, Federal Rules of Bankruptcy Procedure, and local bankruptcy court practices; experience with electronic filing systems and docket management
