Full Job Description

Overview
We are seeking a highly motivated and detail-oriented Bankruptcy and Creditors' Rights Paralegal to join our dynamic legal team. This pivotal role offers the opportunity to work on complex bankruptcy cases, manage creditor claims, and support litigation processes within a fast-paced law office environment. The ideal candidate will demonstrate exceptional organizational skills, legal research expertise, and a proactive approach to case management. Essential Functions and Responsibilities

Attend initial client meetings to gather and assimilate facts to be used in the preparation of the file.
Prepare and file proofs of claim.
Assist with filings and monitoring in bankruptcy dockets.
Prepare draft pleadings and discovery documents in state and federal courts, and bankruptcy court.
Preparation/review of draft loan documents, promissory notes, security agreements, and similar documents.
Conduct searches of UCC-1 financing statements, file UCC-1 financing statements and/or other lien filing documents and manage filings.
Prepare and record documents related to trustee’s sales and manage trustee’s sale process, including draft Deeds of Trust, Notices of Default, Notices of Sale.
Prepare, file, and manage post-judgment collection documents and responses such as garnishments, levies of execution, etc. Maintain ongoing communication with the client to provide status report of pending matters.
Maintain client files.
Prepare initial drafts of correspondence, pleadings, and documents for review by the lawyer.
Interview witnesses and investigate factual matters in contested cases.
Perform preliminary legal research, lien searches and searches of other public records.
Monitor and assist in post judgment efforts to collect balances owed to the client.
Continuous review of Federal, State, and local rules pertaining to bankruptcy and creditors’ rights.
Participate in lawyer and client conferences.
Analyze client documents and files.
Review, revise and discuss all relevant correspondence, documents and filings.
Perform other duties as assigned.

Skills and Educational Requirements

Bachelor’s Degree or degree or certificate from an accredited paralegal program.
Work experience in the legal industry as bankruptcy/creditors’ rights paralegal or a similar role.
Knowledge of and experience with, and ability to understand and apply applicable professional rules of ethics and conduct, and knowledge of ABA Rules of Professional Responsibility.
Assist in the competent and economical delivery of legal services, benefiting both the firm and the client.
Experience and ability to master various computer software programs, including litigation support applications.
Knowledge of legal terminology, forms, documents, practices and procedures.
Proficiency with Microsoft Office, and related programs.
Excellent verbal and written communication skills.
Resourcefulness and ability to work independently.
Excellent organization; ability to prioritize work and handle strict deadlines and multiple tasks.
Attention to detail and ability to creatively problem solve.
Ability to confidently and effectively interact with clients, prospects, referrals, attorneys and other employees in a team environment.
Ability to maintain confidentiality and use discretion and tact.

Physical Demands

Must be able to effectively operate a computer in addition to other office productivity machinery, such as a copier and printer.
Occasionally must be able to lift/carry/push/pull up to 20 to 30 pounds.
Must maintain current driver’s license and be able to meet applicable auto insurance guidelines.
Must be able to safely operate a motor vehicle in the performance of job duties as necessary.
Position will require travel between Omaha and Lincoln offices.
