Main Purpose:

The Expungement Clerk is an entry-level clerical position responsible for processing all phases of new and pending expungements filed in the Circuit Court for Montgomery County. The incumbent provides efficient and quality customer service to the public and other agencies in all areas of the Circuit Court. It is the responsibility of the Expungement Clerk to accurately answer inquiries, enter data, and process documents, primarily relating to expungements of cannabis charges according to the eligibility under the Criminal Law Article. Completes the expungement process from beginning to end using the Odyssey system. Receives, reviews, and processes the petition; locates case documents and prepares the order; then seals the case. Maintains cases throughout the 90 to 120 days required for processing. If an expungement is denied or a hearing is requested, the incumbent sends notices and/or schedules a hearing. Assists customers by telephone or at the counter. Performs other duties as needed outside of assigned responsibilities to support the court?s goals and aid in the improvement and success of the court.

Essential Duties and Responsibilities:

Reviews, accepts and processes cannabis expungement filings for circuit court cases through MDEC/Odyssey and other expungement filings.

Determines correct filing form for expungement request: Form CC-DC-CR-072A, Form CC-DC-CR-072B, Form CC-DC-CR-072C.

Assists customers by telephone or at the counter with basic filing information for expungements.

Completes notifications for orders requiring the expungements or notices for denial.

Performs other related duties as assigned.

Minimum Qualifications:

Education: High school diploma (or GED equivalent).

Experience: One (1) year of work experience, preferably in court operations or in the fields of criminal justice, parole and probation, legal or financial services.

Note:

A Bachelor's Degree may substitute the required work experience.

A Paralegal/Associates Degree or 60 college credits may substitute the required work experience.

A Paralegal Certificate may substitute the required work experience.

Knowledge, Skills, and Abilities:

Knowledge of:

General office practices, procedures, and equipment.

Standard legal forms and documents used in the Judiciary.

Basic English and arithmetic to include, but not limited to, spelling, punctuation, addition, subtraction, multiplication, and division.

Skill in:

Customer service and handling problems tactfully and patiently.

Typing on a personal computer.

Accuracy and attention to detail.

Ability to:

Use standard office and business equipment including, but not limited to, personal computers, word processing, spreadsheets, database software, copier, microfilm machine, register, scanner, fax machine, etc.

Use and maintain alphabetical and numerical filing systems.

Communicate clearly, tactfully, and effectively with judges, the public, police agencies, attorneys, and other court officials and personnel, both verbally and in writing. Understand and abide by departmental rules, regulations, and procedures.

Exercise tact, diplomacy, and impartiality in dealing with the public, law enforcement personnel, and attorneys.

Follow procedures, verbal and written instructions, and protocols for any given assignment.

Use proper grammar, punctuation, and spelling.

Exercise independent judgment in interpreting and applying appropriate policy, procedure, rule, law, and/or regulation to a situation.

Learn and perform all duties related to case processing in the Criminal division.

Multi-task while maintaining a high level of accuracy.

Adapt to changing rules, laws, and procedures.
