Full Job Description

SUMMARY:

Local 26+ year old right of way consultant company is rapidly expanding and looking to hire individuals who are willing and able to support our office and clients across the state of Florida. The ideal candidate(s) will have direct right of way acquisition, negotiation, and/or relocation experience from working for municipalities/government agencies. Relocation costs will be paid for the right candidate(s). Yearly salary is competitive and commensurate with level of experience.

The Right of Way Acquisition/Relocation Agent (referred to as “Agent” below), under the direct supervision of the Project Manager, is primarily responsible for negotiating acquisitions of real property interests from affected landowners using standard right of way techniques, effective communication skills, proper legal procedures, and client specific criteria. Agent is also responsible for providing relocation assistance on complex relocations involving individuals, families, businesses, non-profit organizations, and farm operations displaced as a result of a federally funded or federally assisted projects using proper legal procedures and client specific criteria.

Acquisition Agent Duties:

· Conduct diverse and complex negotiations with landowners (or their designees).

· Draft and/or supervise the preparation of documents for rights of entry, damage claims, contracts, easements, licenses, leases, permits, options to purchase and other documents as may be necessary to acquire adequate rights for the project.

· Acquire title to all project parcels on a schedule consistent with the completion dates requested by the client.

· Achieve a maximum negotiated settlement rate utilizing innovative approaches and prior experience; acquire all properties at the least possible cost to the taxpayer while maintaining the client’s objective.

· In the event we are provided formal parcels to conduct negotiations, provide all necessary notices and conduct all actions in accordance with Florida Statutes Chapters 73, 74 and 337 F.S. as well as the client’s right of way scope requirements to ensure “good faith” negotiations while maintaining the integrity of the client’s production schedule.

· Ensure that the Initiation of Negotiations (IN) and all subsequent negotiations comply with all good faith requirements and all efforts towards an amicable settlement are exhausted before recommending suit.

· Read, understand, and interpret right of way parcel maps/plans and construction drawings.

· Monitor County Clerk records. Search courthouse and other records to determine present property ownership(s) and the extent of interest therein, including liens/encumbrances.

· Advise and assist in establishing a range of indicated values to be used in the acquisition of land and land rights.

· Ensure accuracy and timeliness of data input into status tracking reports and/or databases on assigned parcels.

· Accurately complete all required paperwork in a timely manner to meet deadlines.

· Manage property owner complaints, issues, and needs promptly. Bring to project manager’s attention as soon as possible, if needed.

· Maintain the ability and flexibility to work in cooperation with all those assigned to the client’s office.

· Reference Florida Statutes and apply real estate knowledge as needed. Have advanced understanding of real estate law and terminology.

· Ensure compliance with applicable laws/statutes, rules, regulations, policies, and procedures.

· Attend in-person and virtual meetings.

· Prepare required documents necessary to submit the file for condemnation action.

· Other duties, as required.

Relocation Agent Duties:

· Conduct the ‘Needs Assessment Survey’:

· Conduct interviews with owners and tenants to provide information about the relocation program such as available payments and requirements for receiving assistance.

· Gather specific information about each household or business so appropriate eligibility determinations can be made, and proper replacement housing and/or move cost payments can be calculated.

· Establish priority parcels and coordinate with appraisal and acquisition priorities.

· Present relocation eligibilities to residential and business displacees who will be required to relocate.

· Monitor client and FHWA policy and procedures to ensure full compliance.

· Review relocation appeals and make timely recommendations to the client.

· Maintain records and submit reports for business moves requiring surveillance or monitoring.

· Deliver warrants to payees in accordance with generally accepted practices and client procedures and document accordingly.

· Deliver proper notification to all persons required to relocate, including 90-Day Assurance and 30-Day Notices to Vacate.

· Prepare leaseback and eviction requests for the client as required, and provide sufficient and appropriate documentation.

· Prior to file retirement, audit all relocation files thoroughly, perform QA reviews and prepare a file retirement checklist and critique.

· At the time the displacee moves, Agent shall deliver the Customer Satisfaction Survey.

· Provide general property management support to the client in accordance with all applicable federal, state, and local rules and regulations, including but not limited to:

· Surplus property disposition

· Demolition contracting

· Asbestos abatement contracting and management (AHERA)

· Apply an advanced understanding of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended (URA) and Title 49 CFR, Part 24 to perform right-of-way relocation and acquisitions per project guidelines and state/client regulations.

· Effectively communicate with the displacee to ensure the understanding of the Relocation Assistance Program and requirements.

· Provide advisory assistance to displaced person(s), including personal interviews; preparing, issuing and explaining required notices; offering transportation to view replacement housing, etc.

· Locate comparable housing and compute rent supplement and price differential calculations.

· Perform Decent, Safe and Sanitary Inspections.

· Locate and advise non-residential displacee(s) of suitable replacement sites.

· Prepare and/or obtain Moving Cost Estimates in accordance with client procedures and policy.

· Understand and compute payments for Substitute Personal Property, Actual Direct Loss of Tangible Personal Property and Low Value/High Bulk.

· Evaluate and prepare Reestablishment Payments.

· Analyze criteria and prepare Fixed Payment In-Lieu of Moving and Reestablishment Payment.

· Prepare paperwork and displacees’ claims for payment, when eligible.

· The following types of relocation calculations may be required to facilitate the client’s relocation program:

· Purchase Additive

· Increased Interest Payment

· Eligible Closing Costs Payment

· Rent Supplements

· Move Cost Entitlements

· Contract estimates

· Search expenses

· Storage entitlements

· Scheduled moves (residential)

· Fixed payments (commercial)

· Alternate payments (combination)

· Loss of tangible property

· Business re-establishment expenses

· Incidental expenses

· Support Conceptual Stage Relocation Plan (CSRP) in accordance with Florida Statutes 339.09(2); 339.09(3); and 421.55; 49 CFR Part 24; and 23 CFR Part 710 to comply with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (Public Law 91-646) as amended.

· Other duties, as required.

Minimum Qualifications:

· At least one (1) year of public sector right of way acquisition or negotiation experience and/or training.

· Highly proficient with Microsoft Office Suite, especially: Excel, Word, and Outlook.

· Proficient in the English language.

· Valid Driver's License.

· Active Florida Real Estate License.

Candidates with any of the following will receive additional consideration:

· FDOT or other state DOT experience.

· Google Earth, ArcGIS and data management software experience.

· Experience utilizing the Uniform Relocation Act (URA).

· Bachelor’s Degree.

Relevant Skills:

· Have advanced knowledge of sequence of processes required to complete relocation.

· Understand appraisal theory, appraisal processes and property values.

· Able to work efficiently under tight deadlines, as well as balance multiple projects by prioritizing tasks effectively.

· Demonstrate responsibility, organizational, and planning skills.

· Analytical/creative problem solver, and strong attention to detail.
