About Us
The North Carolina Department of Public Instruction (NCDPI) is charged with implementing the state's public school laws for pre-kindergarten through 12th grade public schools at the direction of the State Superintendent of Public Instruction and State Board of Education.
Description of Work
This position will oversee the state complaint management procedures in accordance with Part B of the Individuals with Disabilities Education Improvement Act and Article 9 of North Carolina General Statute 115C.1.
This position fulfills the state of North Carolina’s legal obligation under the Individuals with Disabilities Education Improvement Act (IDEA). Ensure state-wide compliance with Federal Regulations, State statutes and policies on an individual and systemic basis. Provide information and legal analysis to all informal inquiries. Report dispute resolution data and analysis of data to the Legislature, State Board of Education, the Council on Educational Services for Exceptional Children, and the Office of Special Education Programs (OSEP). Ensure compliance with IDEA, State statutes and policies this position provides training and technical assistance to Local Education Agencies (LEAs), State Operated Programs, parents and organizations.
This is a 90% homebased position and requires 10% minimal travel.
Job Responsibilities:
Conduct comprehensive investigations that includes a review of all relevant documentation submitted by the parties, telephone interviews, email interviews, and an on-site visit, if determined necessary.
Write reports based on findings of fact and conclusions of law in a timely manner to allow for review and feedback prior to issuance of the report.
Determine the corrective action plan for implementation by the local education agency or state-operated program to address the issue(s) of non-compliance revealed in the investigation.
Address the needs of the child (such as compensatory services or monetary reimbursement), appropriate future provision of services for all children with disabilities and ensure procedural compliance.
Submit final reports in a timely manner so signatures may be obtained and the report issued within sixty (60) days, unless there are unusual circumstances requiring an extension of time.
Monitor the implementation of correction action plans through direct communication with the regional consultants and local education agencies to ensure that corrective actions are completed and the complaint is closed within one year of the complaint being filed.
Collaborate with the regional consultants on the technical assistance needed for implementation of the corrective action plan that addresses the incident(s) of non-compliance revealed in an investigation

Recruitment Range: $63,927.00 - $90,000.00
Manager Preferences:
- K nowledge of state and federal laws governing programs and services for children with disabilities is essential in this position.
- Knowledge of education administration related to exceptional children policies and programs, research, and evaluation methods are necessary in completing the majority of the work tasks.

Primary Purpose of the Office of Exceptional Children:
The Office of Exceptional Children provides general supervision, professional learning, and technical assistance to all local education agencies, including charter schools, state operated programs, the innovative school district, lab schools, and other state agencies and approved private agencies that provide special education to children and youth classified as disabled. Approximately 14% of the students being educated in North Carolina are exceptional. Most receive special education services in regular classroom settings; others receive instruction in resource classes. A small percentage of exceptional students receive educational services in separate classes within regular schools, in separate day or residential schools, and sometimes in hospitals or in their homes. It is the mission of the Exceptional Children Division to assure that all these students develop academically, mentally, physically, emotionally, and vocationally through the provision of an appropriate individualized education in the least restrictive environment.

Master's degree in education, school administration, business administration, or public administration from an appropriately accredited institution and four years of responsible administrative experience in an education environment at the local, state, or federal level; or an equivalent combination of education and experience.
