Full Job Description

SMS Holdings is seeking an experienced employment attorney to serve as Senior Counsel, Labor & Employment. This is a newly established role designed for an attorney who enjoys being a trusted advisor, values practical problem-solving over theoretical analysis, and is energized by partnering with executive leadership to influence organizational strategy.

Reporting to the Chief Human Resources Officer, you will serve as the Company's principal legal advisor on employment matters across a diverse portfolio of operating companies with employees throughout the United States. You will work closely with Human Resources, Operations, and senior leadership to navigate complex workplace issues while developing scalable employment practices that support long-term organizational success.

What You'll Do

Your practice will extend well beyond responding to legal claims. You will help shape how employment decisions are made across the enterprise.

Responsibilities include:

Advising executive leadership on complex employment matters involving discipline, termination, disability accommodations, leave administration, wage and hour compliance, reductions in force, restrictive covenants, and workplace investigations.
Leading the Company's strategy for administrative agency matters, including EEOC and state agency charges, and partnering with outside counsel on employment litigation.
Conducting or overseeing sensitive internal investigations involving discrimination, harassment, retaliation, ethics concerns, and executive-level employee relations matters.
Providing practical, business-oriented legal advice that balances legal risk with operational realities.
Drafting and maintaining employment policies, employee handbooks, and legal guidance for a multi-state workforce.
Designing preventive legal strategies that reduce organizational risk through manager education, policy development, and consistent employment practices.
Identifying emerging legal trends and recommending proactive business solutions before issues become disputes.
Collaborating with Human Resources to strengthen employee relations practices across multiple operating companies.
As the function evolves, providing strategic guidance regarding labor relations, collective bargaining agreement interpretation, grievance administration, and union-related matters.

The Attorney We're Looking For

The successful candidate is intellectually curious, exercises excellent judgment, and understands that credibility is earned by providing clear, practical advice that leaders can confidently implement.

You should possess:

Juris Doctor from an accredited law school.
Active license to practice law in at least one U.S. jurisdiction; California licensure or significant California employment law experience is strongly preferred.
Eight or more years of experience representing employers in labor and employment law.
Demonstrated experience advising sophisticated organizations on complex employment issues involving federal and state employment laws.
Experience managing employment litigation, administrative agency matters, and outside counsel.
Exceptional written and verbal communication skills with the ability to influence senior business leaders.
Prior in-house experience is preferred, although accomplished attorneys from employer-side labor and employment practices are encouraged to apply.
