Essential Functions:

Directly supervise the activities of the Human Resources Department.

Ensure compliance with all state and federal laws with respect to employment and benefits.

Provide guidance to employees on employment-related matters, policies, and benefits.

Develop, revise, and/or recommend policies and/or procedures to the General Manager as necessary. Maintain all policies and ensure affected employees receive updates.

Oversee the recruiting/hiring process and the posting of internal/external job openings.

Oversee the administration of employee benefits.

Oversee compliance with Equal Employment Opportunity and Affirmative Action program. Update the Program as necessary and submit for renewal to the Federal Transit Administration (FTA). Investigate EEOC complaints and prepare responses.

Investigate and/or compile documents for miscellaneous complaints, arbitrations, liability claims, lawsuits, Workers’ Compensation claims, etc.

Oversee the Workers’ Compensation program. Serve as the contact person for the Third-Party Administrator and attorney. Ensure that on-the-job injuries are timely filed, and treatment is rendered. Oversee the OSHA recordkeeping. Review all medical reports and provide authorizations to Third-Party Administrator or Medical Manager when necessary. Attend court hearings, mediations, arbitrations, and trials as necessary. Consult with General Manager and authorize settlements as necessary.

Manage the lawsuits resulting from employment or liability claims. Review all court pleadings. Research and answer discovery requests. Attend court hearings, settlement negotiations, and trial as necessary.

Oversee the Medicare Reporting process for liability claims, lawsuits, and Workers’ Compensation claims.

Oversee contractor compliance that pertains to the Human Resources Department. Assist in reviewing proposals and contracts for services or benefits.

Administer the Alcohol and Substance Abuse Program and ensure compliance with the Department of Transportation and Federal Transit Administration. Oversee the annual Drug Free Workplace initiatives. Oversee the testing procedures, documentation, and preparation of the MIS report submitted on an annual basis.

Oversee FMLA compliance and recordkeeping.

Oversee the retirement process. Counsel the employee on retirement options. Ensure paperwork is accurate and timely submitted to the Actuary, Trustee, or City of Tulsa for processing. Serve as a member of the Union Pension Committee.

Prepare the proposal for union negotiations, collect documentation, and schedule the meetings. Serve as a member of the labor contract negotiations team.

Assist in arbitration procedures when necessary and appropriate.

Oversee the Modified Duty Program. Ensure that employees are being utilized promptly and efficiently according to the guidelines.

Assist auditors, produce documents, and respond to audit findings when necessary.

Manage and track requests for a job modification or accommodation. Ensure compliance with the Americans with Disabilities’ Act.

Oversee the unemployment process. Participating in Oklahoma Employment Security Commission unemployment appeal hearings.

Communicate with internal and external customers daily.

Ensure that ADP is set up correctly for employees, benefits, deductions, time, etc.

Work with ADP to implement changes or new service improvements in ADP.

Prepare insurance renewals.

Approve enrollments and benefit changes in ADP.

Prepare, maintain, track, and submit reports.

28. Serve as the point of contact for many company activities.
29. Conduct training classes when necessary.
30. Attend meetings, seminars, and job fairs as needed.
31. Must report to work on a regular and timely basis.
32. Perform other incidental duties as may be required.
Requirements:
Knowledge - Bachelor’s degree required in Business Administration or related field. A combination of knowledge and extensive experience may be considered in lieu of advanced education. Must have knowledge of state and federal laws concerning employment issues. Must be able to communicate effectively with co-workers, managers, MTTA Board of Trustees, and the public. Excellent interpersonal skills are an absolute necessity. The above knowledge and skills must be documented by prior work experience. Professional in Human Resources certification preferred.
Mental Effort - Requires the ability to handle numerous projects and activities at one time. Must be able to work independently and with others when developing policies and procedures. Demonstrated problem solving abilities are essential.
Physical - Extensive sitting, standing and walking are all required in the course of a normal workday. May be required to lift or push 25 pounds.
Audible/Visual Demands - Requires ability to hear telephone and verbal directions given; visually perform essential functions. Ability to view visual display terminal for extended periods.
Miscellaneous – Must be willing to work evenings, weekends, and travel to meetings when necessary. Must be safety conscious and avoid accidents if possible.
