Build and Lead a New Practice Area From the Ground Up

Shane Smith Law is launching an entirely new practice area dedicated to helping homeowners facing foreclosure, mortgage servicing problems, and other serious challenges involving their homes.

We're looking for an experienced attorney who doesn't just want another attorney position.

We're looking for someone who wants to build something.

This attorney will have the opportunity to help create and lead our Homeowner Advocacy Division from the ground up, backed by the resources, marketing capabilities, technology, staff, and infrastructure of an established and growing law firm.

If you have significant experience with foreclosures, mortgage servicing, loss mitigation, bankruptcy, creditor/debtor law, or real estate litigation—and you're interested in becoming the subject-matter leader of a growing practice—we want to talk with you.

The Opportunity

You'll be joining us at the beginning.

Rather than stepping into someone else's established practice, you'll help us determine how this division operates, including but not limited to:

Developing the legal strategy and service offerings
Establishing case evaluation and acceptance criteria
Creating workflows, procedures, and best practices
Helping develop document templates, pleadings, and litigation strategies
Advising on staffing and support needs
Training attorneys and support staff as the division grows
Working with firm leadership to identify opportunities for expansion
Helping establish the firm's reputation in homeowner advocacy
Ultimately helping build a team and practice around your expertise

Our goal is to build a significant homeowner advocacy practice, not simply add another service to our website.

What the Practice Will Handle

The division will assist homeowners dealing with matters such as:

Foreclosure prevention and foreclosure defense
Wrongful foreclosure and foreclosure litigation
Mortgage servicing disputes
Loan modifications
Loss mitigation
Forbearance agreements
Repayment plans
Partial claims and mortgage assistance programs
Short sales
Deeds in lieu of foreclosure
Mortgage and loan document review
Lender and mortgage servicer negotiations
Consumer protection claims involving mortgage servicing
Real estate litigation involving distressed homeowners
Evaluating bankruptcy or other debt-relief options when appropriate

Who We're Looking For

We are particularly interested in attorneys with experience in one or more of the following:

You do not necessarily need to currently represent homeowners.

Attorneys who currently or previously represented banks, lenders, mortgage servicers, creditors, investors, or foreclosure firms are strongly encouraged to apply.

Your knowledge of how lenders and servicers evaluate files, process foreclosures, handle loss mitigation, and approach litigation could be extremely valuable in building a sophisticated homeowner advocacy practice.

The Person We're Looking For

The ideal candidate is an experienced attorney who:

Understands the foreclosure process and mortgage servicing industry
Can identify potential defenses, claims, and resolution strategies
Understands loss mitigation and alternatives to foreclosure
Has strong negotiation and litigation skills
Can analyze complicated mortgage, title, and real estate issues
Is comfortable making strategic decisions
Enjoys solving difficult problems
Can communicate complicated legal issues clearly to clients
Has the leadership ability to eventually manage attorneys and staff
Has an entrepreneurial mindset and enjoys creating and improving systems

Most importantly, we're looking for someone who is excited about the opportunity to take ownership of a practice area and help build it.

We're providing the platform and resources to build a new division. We're looking for the attorney who can provide the legal expertise and leadership to help us build it correctly.

How we build the team.
And ultimately, how large this practice becomes.

As the division grows, we expect this position to grow with it.

Qualifications

J.D. from an accredited law school
Active and in good standing with the applicable State Bar
Meaningful experience involving foreclosure, mortgage servicing, creditor/debtor law, bankruptcy, real estate litigation, consumer financial law, or a closely related field
Strong legal research, writing, negotiation, and analytical skills
Litigation experience preferred
Leadership or management experience is a plus, but not required
Ability and desire to help develop a practice area from its earliest stages

Compensation will be competitive and commensurate with experience, expertise, and the leadership responsibilities of the position.
