Position Summary
Stellarware Corporation is seeking an experienced Attorney to support the Texas Medicaid Estate Recovery Program (MERP). This position will provide legal guidance on probate, estate recovery, creditor claims, real property, exemptions, hardship waivers, and other legal matters related to Medicaid estate recovery.
The Attorney will work closely with project management, paralegals, caseworkers, and operational staff to review complex cases and ensure recovery activities are handled in accordance with applicable Texas and federal laws, regulations, and MERP requirements.
This position is ideal for an attorney who enjoys combining legal analysis with practical case-level problem solving. The Attorney will serve as a legal resource for the MERP team and help ensure complex estate recovery matters are handled accurately, consistently, and in compliance with program requirements.
JOB DESCRIPTION:

ESSENTIAL JOB DUTIES:
- Review complex MERP cases and provide legal guidance on appropriate recovery actions.
- Review probate, estate, property, and court records to determine the State's ability to pursue recovery.
- Prepare and/or review Medicaid estate claims and ensure required filings and presentments are completed within applicable deadlines.
- Provide guidance on probate proceedings, creditor claims, estate administration, heirship, and property ownership.
- Review complex property matters involving deeds, liens, mortgages, trusts, life estates, multiple owners, and other ownership interests.
- Evaluate MERP exemptions, exclusions, and undue hardship waiver requests.
- Assist with disputed claims, insolvent estates, settlements, and other complex recovery matters.
- Communicate with probate courts, county clerks, attorneys, executors, administrators, estate representatives, and other involved parties as needed.
- Research and interpret the Texas Administrative Code, Texas Estates Code, federal Medicaid requirements, and applicable MERP policies.
- Identify cases requiring escalation or additional legal review.
- Provide legal guidance and training to caseworkers, paralegals, and operational staff.
- Assist with the development and review of policies, procedures, notices, templates, workflows, and training materials.
- Monitor legal and regulatory changes that may impact Texas MERP operations.
REQUIRED QUALIFICATIONS:
- Juris Doctor (J.D.) from an accredited law school.
- Active license to practice law.
- Experience in probate, estate administration, Medicaid Estate Recovery, creditor claims, elder law, real estate/property law, healthcare law, or government recovery programs.
- Knowledge of probate proceedings, creditor rights, estate assets, and real property interests.
- Experience reviewing probate filings, court records, deeds, and other legal documents.
- Strong legal research, analytical, written, and verbal communication skills.
- Ability to manage multiple cases, priorities, and legal deadlines.
- Strong attention to detail and sound legal judgment.
PREFERRED QUALIFICATIONS:
- Texas licensure.
- Spanish-speaking or bilingual (English/Spanish).
- Experience working with government agencies or government contractors.
