Full Job Description

POSITION SUMMARY

The Removal Defense Attorney will serve as a front-line litigation attorney in a fast-paced, high-volume practice handling removal proceedings in Immigration Court alongside concurrent federal district court actions. This attorney will independently manage a substantial docket of removal cases—including U visa-based defenses, VAWA-related proceedings, and complex cases involving deferred action violations or administrative delays—while simultaneously coordinating or prosecuting federal court actions, including mandamus petitions and APA-based challenges to agency inaction or unlawful conduct.

This is not a training or mentorship role. We are seeking a self-directed litigation attorney who can identify issues, develop strategy, manage complex parallel tracks of litigation, and produce high-quality work product without day-to-day supervision.

CORE RESPONSIBILITIES

Removal Defense & Immigration Court

Independently manage a high-volume docket of removal proceedings in Immigration Court across multiple jurisdictions
Prepare and file all case pleadings, motions to terminate or administratively close, briefs, and evidentiary submissions
Develop and execute defense strategies for U visa applicants, VAWA self-petitioners, and other humanitarian case types in removal proceedings
Represent clients at master calendar hearings, individual merits hearings, and bond hearings as needed
Identify and pursue available relief including adjustment of status, cancellation, withholding, and CAT protection

Federal Court Litigation — APA / Mandamus

Coordinate federal court filings with ongoing removal proceedings to protect clients' interests across concurrent tracks
Identify systemic patterns across the firm's docket that may support class action or coordinated federal litigation

U Visa Practice Integration

Advise on U visa eligibility and petition strategy for clients in removal proceedings, including those with prior orders
Coordinate with the firm's petition team to ensure seamless integration between U visa filings and removal defense strategy
Monitor agency adjudication timelines and initiate appropriate federal court action when delays trigger actionable APA violations
Stay current on evolving USCIS policy guidance, deferred action practices, and policy changes affecting U visa petitioners in proceedings

Operations & Compliance

Maintain accurate, timely case notes and deadline tracking in the firm's case management system
Work within established firm SOPs for case handling, client communication, and document management
Flag systemic issues, policy changes, or caseload concerns proactively to firm leadership
Mentor junior associates or paralegals on an as-needed basis — without sacrificing personal docket performance

QUALIFICATIONS

Required

J.D. from an ABA-accredited law school; active bar membership in good standing (any U.S. jurisdiction)
Minimum 3 years of immigration litigation experience, with substantial removal defense docket management
Demonstrated experience in federal district court practice — mandamus and/or APA litigation strongly preferred
Hands-on U visa experience, including cases involving clients in removal proceedings or with prior orders
Proven ability to manage a large, complex docket independently in a high-volume environment
Strong legal research and writing skills — ability to produce polished work product under tight deadlines
EOIR-registered or able to register immediately upon hire

Strongly Preferred

Experience with VAWA self-petitions and T visa matters
Familiarity with INA § 212(a)(9)(C) permanent bar waivers or deferred action-based proceedings
Experience coordinating parallel tracks of agency proceedings and federal court litigation
Spanish language proficiency (oral and written) — strongly preferred for client-facing work
Familiarity with high-volume immigration practice technology and case management systems

This role is designed for a litigation attorney who leads from the front. You will join a firm that moves fast, serves thousands of clients, and expects its attorneys to operate with the judgment and independence of experienced practitioners. We invest in our team, but we do not micromanage attorneys — we expect you to own your docket, raise issues proactively, and deliver results.

This role is not suitable for attorneys who require step-by-step supervision, who have not previously managed a litigation docket independently, or who are uncomfortable with the volume and urgency inherent in a large-scale humanitarian practice.
